Ntaganda case: ICC Appeals Chamber delivers judgment on reparative justice

On 1 November 2024,  the Appeals Chamber of the International Criminal Court (“ICC” or “Court”) delivered its judgment on the appeals of the common legal representative of the victims of the attacks and the Defence of Mr Bosco Ntaganda against Trial Chamber II’s “Addendum to the Reparations Order of 8 March 2021, ICC-01/04-02/06-2659” in the case of The Prosecutor v. Bosco Ntaganda. A summary of the judgment was read in open court by Presiding Judge Gocha Lordkipanidze.

Subject to one amendment, the Appeals Chamber unanimously confirmed Trial Chamber II’s decision.

Background: On 8 July 2019, Trial Chamber VI found Bosco Ntaganda guilty of 18 counts of war crimes and crimes against humanity, committed in Ituri, DRC, in 2002-2003. On 7 November 2019, Mr Ntaganda was sentenced to a total of 30 years of imprisonment. On 30 March 2021, the Appeals Chamber confirmed the conviction and the sentence. On 14 December 2022, Mr Ntaganda was transferred to Belgium to serve his sentence of imprisonment.

On 8 March 2021, Trial Chamber VI delivered its Reparations Orderagainst Mr Ntaganda. The Defence of Mr Ntaganda and the Legal Representative of one of the two groups of victims appealed the order. On 12 September 2022, the Appeals Chamber issued its judgment in the appeals and remanded several issues to the Trial Chamber. On 14 July 2023, Trial Chamber II delivered its “Addendum to the Reparations Order of 8 March 2021, ICC-01/04-02/06-2659”. The Defence of Mr Ntaganda and the Legal Representative of one of the two groups of victims appealed that decision.
