Today, 2 November 2026, Pre-Trial Chamber I of the International Criminal Court (ICC) found that the Court may exercise jurisdiction in the case against Osama Elmasry Njeem.  On 30 April 2026, the Registry transmitted an “Admissibility Challenge by Mr. Osama Elmasry/Almasri Njeem Pursuant to Article 17(1)(a) and Article 19 of the Rome Statute”, arguing that the case against Mr Njeem falls outside of the Court’s jurisdiction and is inadmissible. The Chamber received observations from the Prosecution and victims’ representatives.

The Chamber was unanimously satisfied that the Court has jurisdiction over the case. Judges Motoc and Alapini-Gansou considered that the alleged conduct of Mr Njeem continues to be covered by the United Nations Security Council Resolution 1970, which was issued in 2011 under Chapter VII of the Charter of the United Nations.

Judge Flores Liera, while agreeing that the Court has jurisdiction, reiterated her position on the scope and interpretation of Resolution 1970 and her view that the Court's jurisdiction was conferred through the declaration made by the State of Libya under Article 12(3) of the Statute.

Regarding the Defence challenge on the admissibility of the case, the Chamber, stressing the relevance of the principle of complementarity, granted Mr Njeem the possibility to submit additional information and material that is relevant to the Challenge, as well as any update on the proceedings allegedly taking place in Libya by no later than 29 January 2027. The Chamber also renewed its invitation to Libya to respond to the Challenge, if it so wishes, by the same deadline. The Chamber thus deferred its decision on the admissibility challenge and will rule on the matter in due course.

Decision on Osama Almasri Njeem’s challenge to the jurisdiction of the Court and admissibility of the case pursuant to articles 17 and 19 of the Statute

Background: To review jurisdiction in a case, the judges will assess whether the Court has jurisdiction over the alleged crimes, including whether the conduct falls within the Court’s subject-matter jurisdiction, whether the crimes were committed on the territory of a State Party or by one of its nationals, or pursuant to a referral or declaration, and whether the relevant temporal requirements are met. To review the admissibility of a case, the ICC judges will assess whether there are ongoing national proceedings concerning the same conduct, whether the State is genuinely willing and able to carry out those proceedings, and whether the case is of sufficient gravity.

On 18 January 2025, Pre-Trial Chamber I issued a warrant of arrest for Mr Osama Elmasry Njeem, also known as Osama Almasri Njeem, in the Situation in Libya. Mr Osama Elmasry Njeem, who is alleged to have been in charge of prison facilities in Tripoli, where thousands of persons were detained for prolonged periods, is suspected of crimes against humanity and war crimes, including murder, torture, rape and sexual violence, allegedly committed in Mitiga Prison, in Libya, from February 2015 onwards. The crimes set out in the warrant were allegedly committed by Mr Njeem personally, ordered by him, or with his assistance by members of the Special Deterrence Forces – also known colloquially as RADA – (the ‘SDF/RADA’). The crimes took place at Mitiga Prison, against persons imprisoned for religious reasons; for their perceived contraventions to SDF/RADA’s religious ideology; their alleged support or affiliation to the other armed groups; for the purpose of coercion; or a combination thereof. Mr Njeem is not in the ICC’s custody.
