ICC Pre-Trial Chamber I issues its decision on the Prosecutor’s request related to territorial jurisdiction over Palestine

Today, 5 February 2021, Pre-Trial Chamber I of the International Criminal Court ("ICC" or "Court") decided, by majority, that the Court's territorial jurisdiction in the Situation in Palestine, a State party to the ICC Rome Statute, extends to the territories occupied by Israel since 1967, namely Gaza and the West Bank, including East Jerusalem.

On 20 December 2019, the ICC Prosecutor announced the conclusion of the preliminary examination of the Situation in Palestine. The Prosecutor determined that all the statutory criteria under the Rome Statute for the opening of an investigation have been met. A decision on opening the investigation in this situation is in the remit of the ICC Prosecutor. On 22 January 2020, the Prosecutor seized the Chamber under article 19(3) of the Rome Statute, requesting a ruling only on the scope of the Court's territorial jurisdiction in the Situation in the State of Palestine.

In today's decision, Pre-Trial Chamber I recalled that the ICC is not constitutionally competent to determine matters of statehood that would bind the international community. By ruling on the territorial scope of its jurisdiction, the Chamber is neither adjudicating a border dispute under international law nor prejudging the question of any future borders. The Chamber's ruling is for the sole purpose of defining the Court's territorial jurisdiction.

Pre-Trial Chamber I examined the Prosecutor's request as well as the submissions of other States, organisations and scholars who participated as amicus curiae and groups of victims. The Chamber held that, in accordance with the ordinary meaning given to its terms in their context and in the light of the object and purpose of the Statute, the reference to '[t]he State on the territory of which the conduct in question occurred' in article 12(2)(a) of the Statute must be interpreted as a reference to a State Party to the Rome Statute. The Chamber found that, regardless of its status under general international law, Palestine's accession to the Statute followed the correct and ordinary procedure and that the Chamber has no authority to challenge and review the outcome of the accession procedure conducted by the Assembly of States Parties. Palestine has thus agreed to subject itself to the terms of the ICC Rome Statute and has the right to be treated as any other State Party for the matters related to the implementation of the Statute.

Pre-Trial Chamber I noted that, among similarly worded resolutions, the General Assembly of the United Nations in Resolution 67/19 "[reaffirmed] the right of the Palestinian people to self-determination and to independence in their State of Palestine on the Palestinian territory occupied since 1967". On this basis, the majority, composed of Judge Reine Adélaïde Sophie Alapini-Gansou and Judge Marc Perrin de Brichambaut, found that the Court's territorial jurisdiction in the Situation in Palestine extends to the territories occupied by Israel since 1967, namely Gaza and the West Bank, including East Jerusalem.

In addition, the Chamber found, by majority, that the arguments regarding the Oslo Agreements, and its clauses limiting the scope of Palestinian jurisdiction, are not pertinent to the resolution of the issue of the Court's territorial jurisdiction in Palestine. Such matters and other further questions on jurisdiction may be examined when and if the Prosecutor submits an application for the issuance of a warrant of arrest or summons to appear.

Judge Marc Perrin de Brichambaut appended a partly separate opinion on the reasons for which article 19(3) of the Statute is applicable in the present situation. Judge Péter Kovács, Presiding Judge, appended a partly dissenting opinion, in which he disagrees on the fact that Palestine qualifies as '[t]he State on the territory of which the conduct in question occurred' for the purposes of article 12(2)(a) of the Statute, and that the Court's territorial jurisdiction in the Situation in Palestine extends – in a quasi-automatic manner and without any restrictions – to the territories occupied by Israel since 1967, namely Gaza and the West Bank, including East Jerusalem.

توصلت الدائرة التمهيدية الأولى في المحكمة الجنائية الدولية (''المحكمة'') اليوم، الموافق لـ 5 شباط/فبراير 2021، إلى قرار بالأغلبية يقضي بأن الاختصاص الاقليمي للمحكمة بالنسبة للحالة في فلسطين، التي هي دولة طرف في نظام روما الأساسي، هو اختصاص يشمل الأراضي التي تحتلها إسرائيل منذ عام 1967، لا سيما غزة والضفة الغربية، بما في ذلك القدس الشرقية.

وكانت المدعية العامة للمحكمة قد أعلنت في 20 كانون الأول/ديسمبر 2019 انتهاء الدراسة الأولية للحالة في فلسطين. حيث خلصت إلى استيفاء جميع الشروط الميثاقية لفتح تحقيق طبقاً لنظام روما الأساسي. ويبقى قرار الشروع في التحقيق بالنسبة لهذه الحالة بيد المدعية العامة للمحكمة. وفي 22 كانون الثاني/يناير 2020، وعملاً بالمادة 19(3) من نظام روما الأساسي، طلبت المدعية العامة من الدائرة إصدار قرار يتعلق فقط بنطاق الاختصاص الاقليمي للمحكمة بالنسبة للحالة في دولة فلسطين.

وفي قرارها الصادر اليوم، ذكَّرت الدائرة التمهيدية الأولى بأن المحكمة ليست لها الأهلية الميثاقية للفصل في المسائل المتعلقة بقيام دولة ما بشكل مُلزِم للمجتمع الدولي. والدائرة إذ أصدرت حكماً حول نطاق اختصاصها الاقليمي، فهي لا تفصل بذلك لا في تنازعٍ حول الحدود تحت طائلة القانون الدولي ولا هي تستبق الحكم حول مآل الحدود. فقرار الدائرة لا يرمي إلا لتعيين الاختصاص الاقليمي للمحكمة.

لقد تدارست الدائرة التمهيدية الأولى طلب المدعية العامة، إضافةً إلى الدفوع المقدمة من دول أخرى ومن منظمات وباحثين شاركوا بصفتهم جهات صديقة للمحكمة وكمجموعات ممثلة للمجني عليهم. ورأت الدائرة أنه، وبمقتضى المعنى السائد لمصطلحاتها في السياق الذي ترد فيه، وفي ضوء غرض نظام روما الأساسي ومقاصده، فإن الإشارة إلى ''الدولة التي وقع في إقليمها السلوك قيد البحث'' في المادة 12(2)(أ) تُفسَّر وجوباً كإشارة إلى دولة طرف في نظام روما الأساسي. كما توصلت الدائرة إلى أن انضمام فلسطين، وبصرف النظر عن وضعها من منظور القانون الدولي العام، إلى نظام روما الأساسي انتهج المسار الصحيح والمعتاد، وأن الدائرة ليست لها سلطة للطعن أو لمراجعة نتيجة عملية الانضمام التي أجرتها جمعية الدول الأطراف. فَفلسطين قد وافقت بذلك على الخضوع لأحكام نظام روما الأساسي، ومن حقها أن تُعامل مثل أي دولة طرف فيما يتعلق بتطبيق النظام الأساسي.

كما لاحظت الدائرة التمهيدية الأولى أن الجمعية العامة للأمم المتحدة في قرارها رقم 67/19، وكما هو الحال في قرارات صِيغت بعبارات مشابهة، ''[أعادت] تأكيـد حـق الـشعب الفلـسطيني في تقرير المصير والاستقلال في دولته فلسطين على الأرض الفلسطينية المحتلة منذ عام 1967''. وعلى هذا الأساس، توصلت الأغلبية، المتألفة من القاضية رين أديلايد صوفي ألابيني-غانصو والقاضي مارك بيران دو بريشمبو، إلى أن الاختصاص الاقليمي للمحكمة في الحالة في فلسطين يشمل الأراضي التي تحتلها إسرائيل منذ عام 1967، لا سيما غزة والضفة الغربية، بما في ذلك القدس الشرقية.

وإضافة إلى ما تقدم، توصلت الدائرة بالأغلبية إلى أن الحجج المتعلقة باتفاقات أوسلو وبنودها التي تحد من الاختصاص القانوني الفلسطيني ليست ذات صلة بالفصل في مسألة اختصاص المحكمة الاقليمي في فلسطين. فهذه القضايا وما سواها من المسائل المتعلقة بالاختصاص تكون محل نظر إذا ما تقدم المدعي العام بطلب لإصدار أمر بالقبض أو أمر بالحضور.

وقد أرفق القاضي مارك بيران دو بريشمبو رأياً صدر منفصلاً عن القرار جزئياً حول الأسباب التي لأجلها تنطبق المادة 19(3) من النظام الأساسي على هذه الحالة. كما أصدر القاضي بيتر كوفاتش، وهو القاضي الرئيس، رأيا مخالفاً للقرار جزئياً، يخالف فيه حقيقة أن فلسطين مؤهلة لتُعتبر ''الدولة التي وقع في إقليمها السلوك قيد البحث'' لأغراض المادة 12(2)(أ) من النظام الأساسي وأن اختصاص المحكمة يشمل - وبصفة شبه آلية وبلا قيود - الأراضي المحتلة من قبل إسرائيل منذ عام 1967، لا سيما غزة والضفة الغربية، بما في ذلك القدس الشرقية.

היום, ב-5 בפברואר 2021, הערכאה הקדם-משפטית I של בית הדין הפלילי הבינלאומי ("ICC" או "בית הדין") החליטה, ברוב קולות, שהסמכות השיפוטית של בית הדין לגבי המצב בפלשתין, מדינה שהיא צד לחוקת רומא של ה-ICC, חלה על השטחים שמוחזקים על ידי ישראל מאז 1967, כלומר עזה והגדה המערבית כולל מזרח ירושלים.

ב-20 בדצמבר 2019, התובעת מטעם ICC הודיעה על סיום החקירה המוקדמת לגבי המצב בפלשתין. התובעת קבעה שהושגו כול אמות המידה החוקתיות על פי חוקת רומא לפתיחת חקירה. החלטה על פתיחת החקירה במצב זה היא בסמכות התובעת מטעם ICC. ב-22 בינואר 2020, התובעת, על פי סעיף (3)19 של חוקת רומא, פנתה אל הערכאה בבקשה להחלטה רק בנוגע להיקף סמכות השיפוט הטריטוריאלית של בית הדין לגבי המצב במדינת פלשתין.

בהחלטתה היום, הערכאה הקדם-משפטית I הזכירה שה-ICC אינו מוסמך חוקתית להחליט על עניינים הקובעים מעמד של מדינה אשר יחייבו את הקהילה הבינלאומית. בהחלטתה על היקף סמכות השיפוט הטריטוריאלית של בית הדין, הערכאה אינה פוסקת לגבי סכסוך גבולות על פי החוק הבינלאומי, וכמו כן אינה שופטת מראש לגבי שאלות בנוגע לסוגיית גבולות עתידיים כלשהם. המטרה היחידה והבלעדית של החלטת הערכאה היא לקבוע את סמכות השיפוט הטריטוריאלית של בית הדין.

הערכאה הקדם משפטית I בחנה את בקשת התובעת וכן את ההבחנות שהוגשו על ידי מדינות, ארגונים ואנשי אקדמיה אחרים שהשתתפו כ"ידידי בית המשפט," וקבוצות של קורבנות. הערכאה הסכימה שבהתאם למשמעות הרגילה הניתנת למונחים בהקשרם, ולאור המטרה והיעד של החוקה, ההתייחסות אל "המדינה שבשטח אשר בו התרחשה ההתנהגות הנחקרת" בסעיף 12(2)א' של החוקה חייבת להתפרש כהתייחסות למדינה שהיא צד בחוקת רומא. הערכאה מצאה שללא קשר למעמדה על פי החוק הבינלאומי הכללי, הצטרפות פלשתין לחוקה הייתה בהתאם לנוהל הנכון והמקובל וכי לערכאה אין סמכות לאתגר או לבחון את תוצאת נוהל ההצטרפות שהתנהל על ידי מועצת המדינות שהן צד. פלשתין הסכימה בכך לעמוד בתנאים של חוקת רומא של ה-ICC ויש לה הזכות לקבל את אותו היחס כמו כול מדינה שהיא צד בעניינים הנודעים ליישום החוקה.

הערכאה הקדם משפטית I ציינה שבין עוד החלטות המנוסחות באופן דומה, המועצה הכללית של האומות המאוחדות בהחלטה 67/19 "[חזרה ואישרה] את זכות העם הפלשתיני להגדרה עצמית ולעצמאות במדינת פלשתין בשטח הפלשתיני שנכבש מאז 1967." על בסיס זה, הרוב, שכלל את השופטת ריינה אדלייד סופי אלפיני-גאנסו והשופט מרק פרין דה ברישמבו, מצא שהסמכות השיפוטית הטריטוריאלית של בית הדין לגבי ה"מצב בפלשתין" כוללת את השטחים שנכבשו על ידי ישראל מאז 1967, כלומר עזה והגדה המערבית, כולל מזרח ירושלים.

בנוסף לכך, הערכאה קבעה, בדעת רוב, שהנימוקים בקשר להסכמי אוסלו, והסעיפים בהם שמגבילים את היקף סמכות השיפוט הפלשתינית, אינם רלוונטיים להחלטה בנושא הסמכות השיפוטית הטריטוריאלית של בית הדין בפלשתין. אפשר יהיה לבחון עניינים אלה וסוגיות אחרות הנוגעות לסמכות שיפוטית כאשר ואם התובעת תגיש בקשה להוצאת צווי מעצר או זימונים להופעה.

השופט מרק פרין דה ברישמבו הוסיף חוות דעת נפרדת בחלקה בעניין הסיבות בעטיין סעיף (3)19 של החוקה תקף במצב המדובר. השופט פיטר קובאץ', נשיא בית הדין, הוסיף חוות דעת מסתייגת חלקית, שבה הוא מביע אי הסכמה לעובדה שפלשתין עומדת בדרישה שתהיה "המדינה שבשטח אשר בו התרחשה ההתנהגות הנחקרת" למטרות סעיף 12(2)א' של החוקה, וכי הסמכות השיפוטית הטריטוריאלית של בית המשפט במצב בפלשתין חלה – באופן מעין-אוטומטי וללא מגבלות כלשהן – על השטחים שנכבשו על ידי ישראל מאז 1967, כלומר עזה והגדה המערבית, כולל מזרח ירושלים.
