Unsealing and reclassification of certain documents in the case The Prosecutor vs. Germain Katanga

Case : The Prosecutor v. Germain Katanga

Pre-Trial Chamber I issued, on 5 November 2007, a decision in which it unsealed and reclassified certain documents in the record of the case against Germain Katanga. 

Following this decision, and in order to ensure the transparency of the procedure, the Chamber prepared public notes explaining the general character of the following documents, which remain confidential:  

  • A public note regarding the “Decision Rejecting the Prosecution Urgent Request and Establishing a Calendar for the Disclosure of the Supporting Materials of the Prosecution Application for a Warrant of Arrest against Germain Katanga”.
    This decision was issued on 6 July 2007, under the reference number ICC-01/04-01/07-5-US-Exp;
  • A public note regarding the “Decision convening a hearing”.
    This ecision was issued on 27 July 2007, under the reference number ICC-01/04-01/07-13-US-Exp;
  • A public note regarding the “Order relating to the Formatted and Redacted Formatted Versions of the Prosecution Application for a Warrant of Arrest”.
    This order was issued on 16 October 2007, under the reference number ICC-01/04-01/07-21-US-Exp;
  • A public note regarding the “Decision concerning Supporting Materials in relation with the Prosecution’s Application under Article 58 of the Statute”.
    This decision was issued on 26 June 2007, under the reference number ICC-01/04-01/07-35-US-Exp.

Following a warrant of arrest issued under seal by the Chamber on 2 July 2007, Mr Germain Katanga, a Congolese national and alleged commander of the Force de résistance patriotique en Ituri [Patriotic Resistance Force in Ituri] (“FRPI”), was surrendered and transferred to the Court on 17 October 2007. The warrant was unsealed on 18 October 2007. The case against Katanga arises from the situation in the Democratic Republic of Congo which has been under investigation by the Office of the Prosecutor of the International Criminal Court since June 2004, for crimes allegedly committed in DRC since 1 July 2002.
