Statement of the Prosecutor of the International Criminal Court, Fatou Bensouda, on the occasion of the visit of the President of Colombia’s Special Jurisdiction for Peace to the Seat of the Court
Today, 11 July 2018, I was pleased to receive a high-level delegation from the Special Jurisdiction for Peace ("SJP") at the premises of the International Criminal Court in The Hague. The delegation consisted of the President of the SJP, Mrs Patricia Linares; the President of the Appeals Chamber of the SJP, Mr Eduardo Cifuentes Muñoz, and the Magistrate of the Amnesty and Pardon Chamber of the SJP, Ms Lily Rueda Guzmán. The visiting delegation sought to engage with my Office to follow-up on exchanges held in Bogota, Colombia, in the context of a technical visit carried out by my Office in March 2018 and, more recently, during the visit of the Deputy Prosecutor in May 2018.
Today's meeting provided a further opportunity to deepen the dialogue between the SJP and my Office in the context of the ongoing preliminary examination concerning the situation in Colombia. The topics discussed addressed the status of the operations of the special jurisdiction as well as recent activities. The meeting was also valuable in that it enabled a timely exchange on developments relevant to the legal framework regulating the operations of the jurisdiction, including the recent approval of the Rules of Procedure of the SJP.
Today, I restated to the President of the SJP my continuous support for her efforts to ensure justice to the victims in accordance with the letter and spirit of the peace agreement, as well as the principles, values and requirements of the Rome Statute.
The manner the SJP will implement its mandate is intrinsically linked to the aim of achieving sustainable peace in Colombia. Therefore, it is of utmost importance that the special jurisdiction continues to ensure that war crimes and crimes against humanity alleged to have been committed during the armed conflict do not go unpunished. We will continue to be a partner in that endeavour, guided by the exigencies of the Rome Statute.
The ICC's Office of the Prosecutor conducts independent and impartial preliminary examinations, investigations and prosecutions of the crime of genocide, crimes against humanity and war crimes. Since 2003, the Office has been conducting investigations in multiple situations within the ICC's jurisdiction, namely in Uganda; the Democratic Republic of the Congo; Darfur, Sudan; the Central African Republic (two distinct situations); Kenya; Libya; Côte d'Ivoire; Mali; Georgia and Burundi. Pre-Trial Chamber II is seized of the Prosecutor's request for authorisation to commence an investigation into the situation in the Islamic Republic of Afghanistan. The Office is also conducting preliminary examinations relating to the situations in Colombia; the Gabonese Republic; Guinea; Iraq/UK; Palestine; The Philippines, Nigeria; Venezuela and Ukraine.
Hoy, 11 de julio de 2018, me complació recibir una delegación de alto nivel de la Jurisdicción Especial para la Paz ("JEP") en la sede de la Corte Penal Internacional en La Haya. La delegación estaba conformada por la Presidenta de la JEP, la Sra. Patricia Linares; el Presidente de la Sección de Apelación de la JEP, el Sr. Eduardo Cifuentes Muñoz; y la Magistrada de la Sala de Amnistía e Indulto de la JEP, la Sra. Lily Rueda Guzmán. La delegación visitante tenía por objeto entablar una conversación con la Fiscalía a mi cargo, para continuar con los intercambios llevados a cabo en Bogotá, Colombia, en el marco de la visita técnica realizada por la Fiscalía en marzo de 2018 y, más recientemente, durante la visita del Fiscal Adjunto, en mayo de 2018.
La reunión de hoy brindó otra oportunidad de profundizar el diálogo entre la JEP y la Fiscalía en el marco del examen preliminar en curso de la situación en Colombia. Los temas en discusión abordaron el estado de las operaciones de la jurisdicción especial, así como sus actividades recientes. La reunión también fue valiosa al haber hecho posible un diálogo oportuno sobre los desarrollos relevantes para el marco jurídico que regula el funcionamiento de la jurisdicción, incluyendo la aprobación reciente de las Reglas de Procedimiento de la JEP.
Hoy reiteré a la Presidenta de la JEP mi apoyo sostenido a sus esfuerzos por asegurar la justicia para las víctimas, de conformidad con la letra y el espíritu del acuerdo de paz, así como también con los principios, valores y requisitos del Estatuto de Roma.
La forma en que la JEP implemente su mandato está intrínsecamente vinculada al objetivo de lograr la paz sostenible en Colombia. Por consiguiente, es de la mayor importancia que la jurisdicción especial continúe asegurando que los crímenes de guerra y los crímenes de lesa humanidad presuntamente cometidos durante el conflicto armado no queden impunes. Seguiremos siendo un socio en ese esfuerzo, orientados por las exigencias del Estatuto de Roma
La Fiscalía de la CPI realiza exámenes preliminares, investigaciones y enjuiciamientos independientes e imparciales de los crímenes de genocidio y lesa humanidad y crímenes de guerra. Desde 2003, la Fiscalía ha llevado a cabo investigaciones en varias situaciones que son de la competencia de la CPI, a saber, en Uganda; la República Democrática del Congo; Darfur (Sudán); la República Centroafricana (dos investigaciones distintas); Kenya; Libia; Côte d´Ivoire; Malí; Georgia; y Burundi. La Sala de Cuestiones Preliminares III tiene ante sí la solicitud de la Fiscal de autorización para iniciar una investigación de la situación en la República Islámica de Afganistán. La Fiscalía también lleva a cabo exámenes preliminares sobre las situaciones en Colombia; Filipinas; Guinea; Iraq/Reino Unido; Nigeria; Palestina; la República Gabonesa; Ucrania y Venezuela.
