Statement of the Prosecutor of the International Criminal Court, Fatou Bensouda, following the recent violence in the Democratic Republic of the Congo
In response to the violent events that have taken place over the past several days in Kinshasa, Democratic Republic of the Congo (DRC), as well as acts which allegedly could constitute crimes within the jurisdiction of the International Criminal Court ("ICC" or the "Court"), I wish to remind one and all in the DRC that I am monitoring the situation on the ground with the utmost vigilance.
I call on all those potentially involved and on all Congolese stakeholders, on all sides, to exercise calm and restraint, and to refrain from any act of violence against persons or property.
I also call on all actors, irrespective of their official status or political affiliation, to clearly and unequivocally urge their supporters, sympathizers and agents to refrain from committing any act of criminal violence against individuals, and to take the necessary measures to prevent such acts from being committed.
My Office has been investigating in the Democratic Republic of the Congo since 2004 and our work continues. If acts constituting crimes within the jurisdiction of the Court are committed, I will not hesitate to act and take all necessary steps to prosecute those responsible, in line with the principle of complementarity.
The Office of the Prosecutor of the ICC conducts independent and impartial preliminary examinations, investigations and prosecution of the crimes of genocide, crimes against humanity and war crimes. The Office has been conducting investigations in: Uganda, the Democratic Republic of the Congo, Darfur (Sudan), the Central African Republic (two separate investigations), Kenya, Libya, Côte d'Ivoire, Mali and Georgia. The Office is also conducting preliminary examinations relating to the situations in Afghanistan, Colombia, Guinea, Iraq/UK, Palestine, Nigeria, Registered Vessels of Comoros, Greece and Cambodia, Ukraine and Burundi.
