Statement of ICC Prosecutor Karim A. A. Khan KC from Ramallah on the situation in the State of Palestine and Israel
International Criminal Court Prosecutor Karim A.A. Khan KC was in Ramallah as part of his visit to Israel and the State of Palestine, the first by an ICC prosecutor.
On 2 December 2023, the Prosecutor issued this video message from Ramallah. Below is a transcript of his remarks.
Today is the end of my first trip to the State of Palestine. I'm here in Ramallah. It's been a productive day, a long day, in which I've met the President, His Excellency Mahmoud Abbas, the Prime Minister, the Minister of Justice, the Minister of Health, the Minister of Prisons.
I've had the opportunity to engage with victims and heard their accounts, their suffering, both from Gaza and from the West Bank. Pain is real. The loss is acute and I really feel it's a privilege to have had this opportunity to speak with them.
I've also spoken to Palestinian television and I’ve given interviews to newspapers.
My message has been clear. This is an active investigation. It's an investigation that is a priority for my Office and we're moving forward at pace with rigor, with determination and with an insistence that we act, not on emotion, but on solid evidence.
Yesterday, I met Israeli survivors, Israeli family members that have endured so much loss, the horrors of hostage taking and the insecurity of the unknown about where they are and what has happened.
And today, I've also spoken to individuals that have lost their families, loved ones, children, wives, parents in the rubble of Gaza.
I have made it crystal clear. The law is not some cosmetic adornment that can be disregarded. It's a fundamental requirement that must be complied with. Schools, hospitals, churches and mosques, dwelling houses are protected and must not be bombed. I've made it clear what the law is in terms of the principles of distinction, precaution, and proportionality. And leaving aside all of those issues, I've made it also abundantly clear that the law can't be interpreted in a way that it denudes it from meaning, that hollows it out, that fails to achieve what the Geneva Conventions were meant to do, which is to protect the most vulnerable of society, babies and children, the old and the infirm, civilian men and women. This is an insistence that is required by parties to the conflict and by Israel. I made that very clear here.
I emphasised again that humanitarian assistance must be allowed in at pace, at scale in Gaza. It is not acceptable. There's no justification for doctors to perform operations without light, for children to be operated upon without anaesthetics. Imagine the pain of operations on children, on anybody, on any of us, without anaesthetics. And also I emphasised that Hamas must not divert any aid that's given. But I was crystal clear that this is the time to comply with the law. It's already late. But if Israel doesn't comply now, they shouldn't complain later.
I emphasised settler violence is unacceptable. It's something we are investigating, we have been investigating, and we are accelerating investigations. No Israeli settler armed with an ideology and a gun can think it's open season on Palestinians. Israel has a fundamental responsibility as an occupying power, I emphasised, to investigate those crimes, to prosecute those crimes, to prevent their reoccurrence, but to ensure justice. And my Office is investigating that to ensure that those rights are also vindicated.
I emphasise the commonality of loss between any parent when they've lost a loved one. And that the law must be given effect to at this time. That's what the men and women of my Office are trying to do.
We need to build partnerships. We need the trust of the Palestinian community. In the same way, we need the trust of the Israeli community and those that have suffered on the 7th of October. But together with determination, we can ensure that the rule of law is vindicated, not by pious promises or acting in haste, but based upon solid foundations that are the result of independent, impartial investigations. And that's why we have the International Criminal Court.

اليوم تنتهي زيارتي الأولى إلى دولة فلسطين. أنا هنا في رام الله. لقد كان يوما مثمرا وطويلا التقيت فيه بفخامة الرئيس محمود عبّاس، ورئيس الوزراء، ووزير العدل، ووزير الصحة، ووزير هيئة شؤون الأسرى والمحررين
لقد أُتيحت لي الفرصة للقاء المجني عليهم والاستماع إلى شهاداتهم وقصص معاناتهم، في كل من غزة والضفة الغربية. إن الألم حقيقي والخسارة فادحة. وأشعر حقا أنه لشرف كبير أن أُتيحت لي هذه الفرصة للتحدث معهم. لقد تحدثت أيضا في التلفزيون الفلسطيني وأجريت مقابلات مع صحف
لقد كانت رسالتي واضحة. هناك تحقيق جاري ، ويمثل أولوية بالنسبة لمكتبي. ونحن نمضي قدما بخطى ثابتة ودقة وتصميم وإصرار على ان لا تدفعنا عواطفنا، وانما بناء على أدلة دامغة
وبالأمس ألتقيت بناجين إسرائيليين وأفراد من عائلات إسرائيلية تحملت الكثير من الخسائر وأهوال احتجاز الرهائن وانعدام الأمن بشأن مكان وجودهم وما حدث لهم. وتحدثت اليوم أيضا مع أشخاص فقدوا عائلاتهم وأحبائهم وأطفالهم وزوجاتهم وآبائهم تحت أنقاض غزة
لقد قلت ذلك بوضوح شديد. القانون ليس زينة تجميلية يمكن تجاهلها. إنه مطلب أساسي يجب الالتزام به. المدارس والمستشفيات والكنائس والمساجد والبيوت السكنية محمية ولا يجوز قصفها. لقد شرحت بوضوح ما هو القانون من حيث مبادئ التمييز والحيطة والتناسب. وإلى جانب كل هذه المسائل، فقد أوضحت بجلاء أن القانون لا يمكن تفسيره بطريقة تجرده أو تفرغه من معناه، و تفشل في تحقيق ما تهدف اليه اتفاقيات جنيف، ألا وهو حماية الفئات الأكثر ضعفا في المجتمع، الأطفال والرضع، والمسنين والعجزة، والمدنيين من الرجال والنساء. وهذه ضرورة يُطالب بها أطراف النزاع وإسرائيل.
لقد أوضحت ذلك جيدا
وأكدت مرة أخرى على ضرورة السماح بوصول المساعدات الإنسانية إلى غزة بوتيرة وعلى نطاق واسع. هذا غير مقبول. لا يوجد أي مبرر لإجراء عمليات جراحية في الظلام. ولا لأن يقاسي الأطفال آلام العمليات الجراحية من دون تخدير. تخيلوا ألم العمليات على الأطفال، على أي شخص، على أي واحد منا، بدون تخدير. وأكدت أيضا على ضرورة ان تمتنع حماس عن تحويل أو إعاقة وصول أي مساعدات مقدمة
لقد كنتُ شديد الوضوح، أن هذا هو الوقت للامتثال للقانون، ولقد تأخر الوقت بالفعل. ولكن إذا لم تمتثل إسرائيل الآن، فلا ينبغي لها أن تشتكي لاحقا
وأكدت على أن عنف المستوطنين غير مقبول. وهذا أمر كنا ومازلنا نحقق فيه، ونعمل على تسريع وتيرة التحقيقات
لا يمكن لأي مستوطن إسرائيلي مسلح بأيديولوجية وسلاح أن يعتقد أن هذا موسم مفتوح على الفلسطينيين. وأكدت على أن إسرائيل تتحمل مسؤولية أساسية، باعتبارها قوة احتلال، في التحقيق في هذه الجرائم، وملاحقة مرتكبيها قضائيا، ومنع تكرارها، ولكن أيضا ضمان تحقق العدالة. ويقوم مكتبي بالتحقيق في هذا الأمر للتأكد من احترام هذه الحقوق أيضا
وأكدت على القواسم المشتركة للخسارة بين أي أب، أو أم حين يفقدون فردا عزيزا. وأن القانون يجب أن يدخل حيز التنفيذ في هذا الوقت. وهذا ما يحاول الرجال والنساء في مكتبي القيام به. نحن بحاجة إلى بناء شراكات. نحن بحاجة إلى ثقة المجتمع الفلسطيني. وبنفس الطريقة، نحن بحاجة إلى ثقة المجتمع الإسرائيلي وأولئك الذين عانوا في 7 تشرين الأول/أكتوبر. معا بالعزيمة نستطيع السعي لضمان سيادة القانون، ليس بوعود شكلية، أو بتصرفات متسرعة، بل بناء على أسس متينة ناتجة عن تحقيقات مستقلة ومحايدة. ولهذا السبب لدينا المحكمة الجنائية الدولية

היום הסתיים הביקור הראשון שלי למדינת פלסטין. אני כאן ברמאללה. זה היה יום פורה, יום ארוך, שבמהלכו פגשתי את כבוד הנשיא מחמוד עבאס, ראש הממשלה, שר המשפטים, שר הבריאות, ושר בתי הסוהר.
הייתה לי הזדמנות לתקשר עם קורבנות ושמעתי את הדיווחים שלהם, את הסבל שלהם, הן מעזה והן מהגדה המערבית. כאב זה הוא אמיתי. האובדן הוא ממשי ואני באמת מרגיש שזאת זכות שהיתה לי ההזדמנות לשוחח איתם.
דיברתי גם לטלוויזיה הפלסטינית והענקתי ראיונות לעיתונות.
המסר שלי היה ברור. זוהי חקירה פעילה. זו חקירה שנמצאת בראש סדר העדיפויות של המשרד שלי ואנחנו מתקדמים בקצב, ביסודיות, בנחישות ובהתמדה שנפעל, לא על-פי רגש, אלא לפי ראיות מוצקות.
אתמול נפגשתי עם ניצולים ישראלים, עם בני משפחה ישראלים שחוו אובדן כה גדול, את זוועות חטיפת בני משפחתם וחבריהם כבני ערובה, ואת חוסר הביטחון וחוסר הידע היכן הם נמצאים ומה התרחש.
והיום, שוחחתי גם עם אנשים שאיבדו את משפחותיהם, יקיריהם, ילדיהם, נשותיהם, והוריהם בהריסות עזה.
הבהרתי את עמדתי באופן הברור ביותר. החוק הוא לא איזה קישוט קוסמטי שאפשר להתעלם ממנו. זו דרישה בסיסית שיש לציית לה. בתי ספר, בתי חולים, כנסיות ומסגדים, ובתי מגורים, הם מבנים מוגנים ואסור להפציצם. הבהרתי את מהות החוק מבחינת עקרונות ההבחנה, הזהירות והמידתיות. אך נניח לרגע את כל הסוגיות הללו, הבהרתי היטב שלא ניתן לפרש את החוק באופן המפשיט אותו מתוכן וממשמעות, שמרוקן אותו, שלא מונע ממנו להשיג את מטרותיהן של אמנות ז'נבה. כלומר, להגן על הפגיעים ביותר בחברה, על תינוקות וילדים, זקנים וחלשים, אזרחים, גברים ונשים. כל הצדדים לסכסוך, ביניהם ישראל, מחויבים לעמוד בדרישות הללו באופן בלתי מתפשר. הבהרתי את זה באופן מאד ברור כאן.
הדגשתי שוב שיש לאפשר סיוע הומניטרי בקצב מהיר, ובקנה מידה מתאים בעזה. זה לא מקובל, ואין הצדקה שרופאים יבצעו ניתוחים ללא אור, שילדים ינותחו ללא חומרי הרדמה. דמיינו את הכאב של ניתוחים בילדים, בכל אחד, בכל אחד מאיתנו, ללא חומרי הרדמה. וגם הדגשתי שאסור לחמאס להסיט שום סיוע שניתן. אבל הבהרתי שזהו הזמן לציית לחוק. זה כבר מאוחר. אבל אם ישראל לא עומדת בדרישות כעת, הם לא צריכים להתלונן אחר כך.
הדגשתי גם שאלימות מתנחלים אינה מתקבלת על הדעת. זהו משהו שאנחנו חוקרים, שחקרנו, ושאנו מאיצים את קצב החקירות. אף מתנחל ישראלי חמוש בעל אידאולוגיה קיצונית ונשק יכול להרגיש שהוא יכול לפגוע בלא משים באזרחים פלסטינים. הדגשתי, שלישראל יש אחריות בסיסית ככוח כובש, לחקור את הפשעים הללו, להעמיד לדין את האחראים לפשעים הללו, למנוע את הישנותם, ולהבטיח שיעשה הצדק. המשרד שלי חוקר את זה כדי להגן על זכויות הנפגעים ולהבטיח הכרה בסבלם.
אני מדגיש את המשותף שבאובדנו של כל הורה כאשר הוא מאבד אדם אהוב. וכי יש לתת לחוק תוקף בשעה זו. זה מה שהגברים והנשים של המשרד שלי מנסים לעשות.
אנחנו מוכרחים לעבוד בשיתוף. אנחנו צריכים את האמון של הקהילה הפלסטינית. באותה מידה, אנו זקוקים לאמון של הקהילה הישראלית ושל אלה שסבלו ב-7 באוקטובר. יחד, כשנפעל באופן נחוש , נוכל להבטיח ששלטון החוק יהיה מוצדק, יראה ויעשה. ולא על ידי הבטחות מתחסדות או פעולות נחפזות, רק למראית עין. שלטון החוק מבוסס על יסודות מוצקים שהם תוצאה של חקירות עצמאיות ובלתי תלויות. וזו תמצית מהותו של בית המשפט הפלילי הבין-לאומי.
