The Presidency of the Assembly of States Parties to the Rome Statute reaffirms its unwavering support for the International Criminal Court
The Presidency of the Assembly of States Parties to the Rome Statute refers to threats against the International Criminal Court as well as measures announced against its Prosecutor and Judges involved in the issuance of arrest warrants in the Ukraine situation. The Presidency of the Assembly regrets these attempts to hinder international efforts to ensure accountability for acts that are prohibited under general international law.
The Presidency of the Assembly emphasizes that the Court, its elected officials, and its staff have the strong support of the Assembly of State Parties to the Rome Statute. We reaffirm its full confidence in the Court as an independent and impartial judicial institution and reiterate our strong commitment to uphold and defend the principles and values enshrined in the Rome Statute and to preserve its integrity undeterred by any threats.
The International Criminal Court embodies our collective commitment to fight impunity for the gravest international crimes. As an institution of last resort, the Court is complementary to national jurisdictions. We call on all States to respect its judicial and prosecutorial independence.
The Assembly of States Parties is the management oversight and legislative body of the ICC. It is comprised of representatives of States that have ratified or acceded to the Rome Statute. The Presidency of the Assembly is currently composed of H.E. Ms. Silvia Fernández de Gurmendi, (Argentina) President; and H.E. Ms. Kateřina Sequensová (Czech Republic) and H.E. Mr. Robert Keith Rae (Canada), Vice-Presidents.
La Presidencia de la Asamblea de los Estados Partes del Estatuto de Roma hace referencia a las amenazas contra la Corte Penal Internacional, así como a las medidas anunciadas contra su Fiscal y Jueces involucrados en la emisión de órdenes de arresto en la situación de Ucrania. La Presidencia de la Asamblea lamenta estos intentos de obstaculizar los esfuerzos internacionales para garantizar la rendición de cuentas por actos que están prohibidos por el derecho internacional general.
La Presidencia de la Asamblea enfatiza que la Corte, sus funcionarios electos y su personal cuentan con el firme apoyo de la Asamblea de los Estados Partes del Estatuto de Roma. Reafirmamos su plena confianza en la Corte como institución judicial independiente e imparcial y reiteramos nuestro firme compromiso de defender y defender los principios y valores consagrados en el Estatuto de Roma y de preservar su integridad ante cualquier amenaza.
La Corte Penal Internacional encarna nuestro compromiso colectivo de luchar contra la impunidad de los crímenes internacionales más graves. تشير رئاسة جمعية الدول الأطراف في نظام روما الأساسي إلى التهديدات التي تتعرض لها المحكمة الجنائية الدولية فضلا عن التدابير المُعلنة ضد المدعي العام والقضاة المشاركين في إصدار أوامر الاعتقال في الحالة في أوكرانيا. وتأسف رئاسة الجمعية لهذه المحاولات التي تهدف إلى عرقلة الجهود الدولية الرامية إلى ضمان المساءلة عن الأعمال التي تحظّرها أحكام القانون الدولي العام.
وتشدد رئاسة الجمعية على أن المحكمة ومسؤوليها المنتخبين وموظفيها يحظون بدعم قوي من جمعية الدول الأطراف في نظام روما الأساسي. ونؤكد من جديد ثقة الجمعية الكاملة بالمحكمة بوصفها مؤسسة قضائية مستقلة ومحايدة، ونكرر تأكيد التزامنا القوي بدعم المبادئ والقيم المكرّسة في نظام روما الأساسي والدفاع عنها والحفاظ على نزاهتها دون أن تردعها أي تهديدات.
إن المحكمة الجنائية الدولية إنما تجسّد التزامنا الجماعي بمكافحة الإفلات من العقاب على أخطر الجرائم الدولية. والمحكمة هي محكمة الملاذ الأخير وتُكمّل النظم القضائية الجنائية الوطنية. وإننا ندعو جميع الدول إلى احترام استقلالها القضائي واستقلال الادعاء العام.
إن جمعية الدول الأطراف هي الهيئة الإدارية والتشريعية للمحكمة الجنائية الدولية. وتتألف من ممثلي الدول التي صدقت على نظام روما الأساسي أو انضمت إليه. وتتألف رئاسة الجمعية حاليا من سعادة السيدة سيلفيا فرنانديز دي غورمندي (الأرجنتين)، رئيسة؛ وسعادة السيدة كاترينا سيكوينسوفا (الجمهورية التشيكية) وسعادة السيد روبرت كيث راي (كندا)، نائبي الرئيس.
