Assembly of States Parties concludes its twenty-first session
The Assembly of States Parties to the Rome Statute of the International Criminal Court ("the Assembly") held its twenty-first session from 5 to 9 December 2022 at the World Forum Convention Center in The Hague. The Assembly was attended by States Parties, Observer States, international and regional organizations as well as non-governmental organizations.
The session was chaired by the President of the Assembly, H.E. Ms. Silvia Fernández de Gurmendi. In closing the session, the President stated: “I trust that we will be able to carry forward the mandates contained in the resolutions which we have adopted today. I wish to sincerely thank all States Parties, members of civil society, Observer States, and of course the Court, for their support and cooperation, without which we would not have been able to successfully conclude our work.”
The Assembly elected seven members of the Committee on Budget and Finance. Five members were elected for a three-year term starting on 1 January 2023: Mr. Urmet Lee (Estonia), Mr. Daniel McDonnell (United Kingdom of Great Britain and Northern Ireland), Mr. Klaus Stein (Germany), Mr. Pascual Tomás Hernández (Spain), and Ms. Ana Patricia Villalobos Arrieta (Costa Rica). Ms. Jasleen Chaona Chirembo (Malawi) and Mr. Sahr Lahai Jusu (Sierra Leone) were elected to share the seat allocated to the African group, serving one year and a half term each. In addition, the Assembly adopted a decision on the allocation of seats on the Committee on Budget and Finance.
The Assembly held its General debate, enriched by the participation of ministers, international organizations and representatives of non-governmental organizations. The Assembly held two thematic plenary sessions: one on cooperation and one on the Review of the International Criminal Court and the Rome Statute system. Numerous side events were held during the session.
The Assembly adopted five resolutions by consensus on: the programme budget for 2023, cooperation, the Review of the International Criminal Court and the Rome Statute system, the strengthening the International Criminal Court and the Assembly of States Parties and on amendments to rule 140 of the Rules of Procedure and Evidence. The Assembly also adopted a recommendation on the Election of the Registrar, which is submitted for consideration of the judges who will elect the Registrar in the first trimester of 2023.
The Assembly adopted the 2023 programme budget of the Court totalling €169,649,200 and a staffing level of 970.
At its closing plenary session, the President, on behalf of the Assembly, expressed the deep appreciation for the outstanding contribution of the Registrar, Mr. Peter Lewis, to the Rome Statute system and in particular for his exemplary steering of the Registry during the five years he has held the post.
The twenty-second session of the Assembly will be held from 4 to 14 December 2023 at the United Nations Headquarters in New York.

The Assembly of States Parties is the management oversight and legislative body of the ICC. It is comprised of representatives of States that have ratified or acceded to the Rome Statute. President Silvia Fernández de Gurmendi was elected President of the Assembly for a three-year mandate in February 2021.
La Asamblea de los Estados Partes del Estatuto de Roma de la Corte Penal Internacional ("la Asamblea") celebró su vigésimo primer período de sesiones del 5 al 9 de diciembre de 2022 en el Centro de Convenciones del World Forum en La Haya. A la Asamblea asistieron Estados Partes, Estados observadores, organizaciones internacionales y regionales, así como organizaciones no gubernamentales.
El período de sesiones fue presidido por la Excma. Sra. Silvia Fernández de Gurmendi, Presidenta de la Asamblea. Al clausurar el período de sesiones, la Presidenta expresó: “Confío en que seremos capaces de llevar adelante los mandatos contenidos en las resoluciones que hoy hemos adoptado. Deseo agradecer sinceramente a todos los Estados Partes, miembros de la sociedad civil, Estados observadores y, por supuesto, a la Corte, por su apoyo y cooperación, sin los cuales no hubiéramos podido concluir con éxito nuestro trabajo”.
La Asamblea eligió a siete miembros del Comité de Presupuesto y Finanzas. Se eligieron cinco miembros por un período de tres años a partir del primero de enero de 2023: Sr. Urmet Lee (Estonia), Sr. Daniel McDonnell (Reino Unido de Gran Bretaña e Irlanda del Norte), Sr. Klaus Stein (Alemania), Sr. Pascual Tomás Hernández (España), y la Sra. Ana Patricia Villalobos Arrieta (Costa Rica). La Sra. Jasleen Chaona Chirembo (Malawi) y el Sr. Sahr Lahai Jusu (Sierra Leona) fueron elegidos para compartir el escaño asignado al grupo africano, por un período de un año y medio cada uno. Además, la Asamblea adoptó una decisión sobre la asignación de puestos en el Comité de Presupuesto y Finanzas.
La Asamblea celebró su debate general, que se vio enriquecido con la participación de ministros, organismos internacionales y representantes de organizaciones no gubernamentales. La Asamblea celebró dos sesiones plenarias temáticas: una sobre cooperación y otra sobre la Revisión de la Corte Penal Internacional y el sistema del Estatuto de Roma. Durante el período de sesiones se celebraron numerosos actos paralelos.
La Asamblea aprobó por consenso cinco resoluciones sobre: el presupuesto por programas para 2023, la cooperación, la Revisión de la Corte Penal Internacional y el sistema del Estatuto de Roma, el fortalecimiento de la Corte Penal Internacional y la Asamblea de los Estados Partes y sobre enmiendas a la regla 140 de la Reglas de Procedimiento y Prueba. La Asamblea también adoptó una recomendación sobre la Elección del Secretario, la cual se somete a la consideración de los jueces que elegirán al Secretario en el primer trimestre de 2023.
La Asamblea aprobó el presupuesto por programas de la Corte para 2023 por un total de 169.649.200 euros y una plantilla integrada por 970 personas.
En su sesión plenaria de clausura, la Presidenta, en nombre de la Asamblea, expresó su profundo agradecimiento por la destacada contribución del Secretario, Sr. Peter Lewis, al sistema del Estatuto de Roma y, en particular, por su dirección ejemplar de la Secretaría de la Corte durante los cinco años que ha ocupado el cargo.
El vigésimo segundo período de sesiones de la Asamblea se llevará a cabo del 4 al 14 de diciembre de 2023 en la Sede de las Naciones Unidas en Nueva York.
