The warrant of arrest was issued under seal against Paul Gicheru and Philip Kipkoech Bett on 10 March 2015 and unsealed on 10 September 2015, for offences against the administration of justice consisting in corruptly influencing witnesses regarding cases from the situation in Kenya. On 11 December 2020, Pre-Trial Chamber A severed the cases against Paul Gicheru and Philip Kipkoech Bett. Philip Kipkoech Bett is not in ICC custody.

Gaddafi

The warrant of arrest for Saif Al-Islam Gaddafi was issued on 27 June 2011. He is not in the Court's custody. Case also involved charges Muammar Gaddafi and Abdullah Al-Senussi in warrant issued on 27 June 2011. Case against Abdullah Al-Senussi was declared inadmissible on 11 October 2013. Case against Muammar Gaddafi was terminated on 22 November 2011, following his death.

Harun

The warrant of arrest for alleged war crimes and crimes against humanity allegedly committed in Darfur (Sudan) was issued in this case on 27 April 2007. Ahmad Harun is still at large.

Hussein

A warrant for arrest for Abdel Raheem Muhammad Hussein was issued on 1 March 2012. The suspect is at large.

Kony et al.

The warrants of arrest in this case were issued under seal on 8 July 2005 and unsealed on 13 October 2005. The suspects are still at large. While case originally involved Raska Lukwiya and Okot Odhiambo, proceedings against them were terminated due to their passing.

Mokom

The warrant of arrest against Maxime Jeoffroy Eli Mokom Gawaka was issued under seal on 10 December 2018 for war crimes and crimes against humanity allegedly committed in the Central African Republic. Mr Mokom was surrendered to the ICC on 14 March 2022.
On 22 March 2022, Maxime Jeoffroy Eli Mokom Gawaka made his first appearance before Pre-Trial Chamber II.
On 22 – 24 August 2023, the confirmation of charges hearing in this case was held before Pre-Trial Chamber II to determine whether or not there is sufficient evidence to establish substantial grounds to believe that the suspect committed each of the crimes charged.
Next steps: The Defence, Prosecutor and the Legal representatives of victims will have until 14 September 2023 to complete their presentations by way of written submissions, to which the Defence and Prosecution can respond by 26 September 2023 at the latest, while the Defence may reply by 2 October 2023. Within 60 days from the receipt of the Defence’s reply on 2 October 2023, the judges will issue their decision. The Pre-Trial Chamber may then:

confirm those charges for which the Chamber has determined that there is sufficient evidence, and commit the suspect to trial before a Trial Chamber;
