Venezuela I situation: ICC Appeals Chamber to hold hearing on appeals against authorisation to resume investigations on 7 and 8 November 2023 – Practical information
On 7 and 8 November 2023 from 9:00 to 15:00 (The Hague time), the Appeals Chamber of the International Criminal Court (ICC) will hold a hearing on the appeal of the Bolivarian Republic of Venezuela against Pre Trial Chamber I’s decision authorising the resumption of the investigation in the situation. In addition to receiving written submissions in this appeal, the Appeals Chamber is convening a hearing to fully address the novel and complex issues that arise in this appeal.
At this hearing, the Office of the Prosecutor, the Representatives of the Bolivarian Republic of Venezuela and the Office of Public Counsel for Victims (OPCV) will be given an opportunity to address specific issues arising from their submissions and to respond to questions of the Appeals Chamber. No judgment is expected to be delivered at the hearing, it will be announced at a later stage.
The Appeals Chamber in this appeal is composed of Judge Marc Perrin de Brichambaut, Presiding, Judge Piotr Hofmański, Judge Luz del Carmen Ibáñez Carranza, Judge Solomy Balungi Bossa and Judge Gocha Lordkipanidze.
Directions on the conduct of the hearing
Background: Venezuela ratified the Rome Statute on 7 June 2000. On 27 September 2018, the Office of the Prosecutor received a referral from a group of States Parties to the Rome Statute, namely the Republic of Argentina, Canada, the Republic of Colombia, the Republic of Chile, the Republic of Paraguay, and the Republic of Peru, regarding the situation in the Venezuela since 12 February 2014. On 3 November 2021, the Prosecution announced its decision to proceed with investigations.
On 21 April 2022, the Prosecution notified Pre-Trial Chamber I that it had received a request from Venezuela to defer the Office's investigations in favour of the actions carried out by the national authorities of Venezuela, pursuant to article 18(2) of the Rome Statute.
On 1 November 2022, the Prosecution requested the Pre-Trial Chamber to resume the investigation in this Situation. On 27 June 2023, Pre-Trial Chamber I authorised the ICC Prosecution to resume its investigation in the situation in the Bolivarian Republic of Venezuela I, pursuant to article 18(2) of the Statute.
On 3 July 2023, Venezuela submitted its notice of appeal against the Pre-Trial Chamber’s Article 18(2) Decision. On 14 August 2023, Venezuela filed its appeal brief.
On 21 July 2023, the Appeals Chamber granted a request of the OPCV and invited it to submit written observations on Venezuela’s appeal brief in relation to the general interests of victims. On 24 August 2023, the Appeals Chamber granted, in part, the victims’ requests, by allowing victims to make representations, with the assistance of their legal representatives if they so wish, and instructed the Victims Participation and Reparations Section to collect and transmit to the Appeals Chamber representations from any interested victim and victims group, with the assistance of their legal representatives if they so wish, and submit a report thereon.
On 13 September 2023, the Prosecutor filed his response to Venezuela’s appeal brief, and the OPCV submitted its observations.

Los días 7 y 8 de noviembre de 2023 de 9:00 a 15:00 (hora de La Haya), la Sala de Apelaciones de la Corte Penal Internacional (CPI) celebrará una audiencia sobre el recurso de apelación de la República Bolivariana de Venezuela contra la decisión de la Sala de Cuestiones Preliminares I que autoriza la reanudación de la investigación en la situación. Además de recibir las alegaciones escritas en este recurso, la Sala de Apelaciones celebrará una audiencia para abordar íntegramente las cuestiones novedosas y complejas que se plantean en el mismo.
En esta audiencia, la Fiscalía, los representantes de la República Bolivariana de Venezuela y la Oficina Pública de Defensa de las Víctimas (OPCV por sus siglas en inglés) tendrán la oportunidad de abordar cuestiones específicas derivadas de sus alegaciones y de responder a las preguntas de la Sala de Apelaciones. No está previsto que se dicte sentencia en la audiencia, se anunciará más adelante.

Contexto: Venezuela ratificó el Estatuto de Roma el 7 de junio de 2000. El 27 de septiembre de 2018, la Fiscalía recibió una remisión de un grupo de Estados Partes del Estatuto de Roma, a saber, la República Argentina, Canadá, la República de Colombia, la República de Chile, la República del Paraguay y la República del Perú, en relación con la situación de Venezuela desde el 12 de febrero de 2014. El 3 de noviembre de 2021, la Fiscalía anunció su decisión de abrir una investigación.
El 21 de abril de 2022, la Fiscalía notificó a la Sala de Cuestiones Preliminares I que había recibido por parte de Venezuela una solicitud de inhibición de las investigaciones de la Fiscalía en favor de las actuaciones emprendidas por las autoridades nacionales de Venezuela, de conformidad con el artículo 18, párrafo 2, del Estatuto de Roma.
El 1 de noviembre de 2022, la Fiscalía solicitó a la Sala de Cuestiones Preliminares reanudar la investigación en esta situación. El 27 de junio de 2023, la Sala de Cuestiones Preliminares I autorizó a la Fiscalía de la CPI a reanudar su investigación sobre la situación de la República Bolivariana de Venezuela I, conforme al artículo 18, párrafo 2, del Estatuto.
El 3 de julio de 2023, Venezuela comunicó su voluntad de apelar la Decisión del artículo 18, párrafo 2, del Estatuto emitida por Sala de Cuestiones Preliminares. El 14 de agosto de 2023, Venezuela presentó su escrito de apelación.
El 21 de julio de 2023, la Sala de Apelaciones accedió a una solicitud de la OPCV e invitó a presentar observaciones escritas al escrito de apelación de Venezuela en relación con los intereses generales de las víctimas. El 24 de agosto de 2023, la Sala de Apelaciones accedió, en parte, a las solicitudes de las víctimas, al permitir que presentaran observaciones, con la asistencia de sus representantes legales si así lo deseaban y ordenó a la Sección de Reparación y Participación de las Victimas que recabara y transmitiera a la Sala de Apelaciones, las observaciones de cualquier víctima o grupos de víctimas interesadas, con la asistencia de sus representantes legales si así lo deseaban y que presentara un informe al respecto.
El 13 de septiembre de 2023, el Fiscal presentó su respuesta al escrito de apelación de Venezuela y la OPCV presentó sus observaciones.
