Symposium in commemoration of the twenty-fifth anniversary of the adoption of the Rome Statute
On 12 and 13 October 2023, the Assembly of States Parties to the Rome Statute of the International Criminal Court ("the Assembly") commemorated the twenty-fifth anniversary of the adoption of the Rome Statute in Siracusa, Italy with a symposium entitled Strategic Vision for the Next Decade: How to Ensure Consistent and Sustainable Support for the International Criminal Court”. The symposium, part of the commemoration process of the twenty-fifth anniversary of the adoption of the Rome Statute launched by the Assembly in The Hague on 12 July and continued in New York on 17 July 2023, was organized by the Siracusa Institute for criminal justice and human rights with the support of the Assembly, and was attended by States Parties, Observer States, the Court, international and regional organizations as well as non-governmental organizations.
On the first day of the symposium, opening remarks were delivered by Mr. Jean-François Thony, President of the Siracusa International Institute for Criminal Justice and Human Rights; Her Excellency Ms. Silvia Fernández de Gurmendi, President of the Assembly; His Excellency Judge Piotr Hofmański, President of the Court; and Mr. Pasquale Velotti, Deputy Head of the Service for Legal Affairs, Diplomatic Disputes and International Agreement of the Italian Ministry of Foreign Affairs and International Cooperation. An overview of the Symposium was also delivered by the General Rapporteur for the event, Mr. William Schabas.
During the two-day event, attendees participated in four panel discussions during which they reflected on opportunities for reinforcing the Rome Statute’s substantive criminal scope through the inclusion of new crimes; discussed the lessons learned from 25 years of operationalising the principle of complementarity in practice and jurisprudence; considered future prospects for ensuring victims’ rights to truth, justice and reparation and a victim-centred approach; and reflected on the future prospects and challenges for the Court’s governance and functioning. Participants also received a presentation on the Ethica Principles for International Criminal Judges during the symposium.
A Declaration adopted at the conclusion of the symposium reaffirmed the importance of strengthening the Court, encouraged States Parties to cooperate with it, recalled the principle of complementarity and called for the effective implementation of the Rome Statute, the strengthening of the institutional framework of the Court and the Rome Statute system. The Declaration also condemned acts of intimidation and attacks against the Court and reiterated support for the Court as an independent, impartial court of law, standing firmly by its elected officials, personnel and all those cooperating with it.

Los días 12 y 13 de octubre de 2023, la Asamblea de los Estados Partes en el Estatuto de Roma de la Corte Penal Internacional (“la Asamblea”) conmemoró el vigésimo quinto aniversario de la adopción del Estatuto de Roma en Siracusa (Italia) con un simposio titulado “Visión estratégica para la próxima década: cómo garantizar un apoyo coherente y sostenible para la Corte Penal Internacional”. Este simposio, que forma parte del proceso de conmemoración del vigésimo quinto aniversario de la adopción del Estatuto de Roma iniciado por la Asamblea en La Haya el 12 de julio y que continuará en Nueva York el 17 de julio de 2023, fue organizado por el Instituto de Siracusa para la justicia penal y los derechos humanos con el apoyo de la Asamblea, y además contó con la participación de Estados Partes, Estados observadores, la Corte, organizaciones internacionales y regionales, así como organizaciones no gubernamentales.
El primer día del simposio dieron discursos de apertura el Sr. Jean-François Thony, Presidente del Instituto Internacional de Justicia Penal y Derechos Humanos de Siracusa; la Excma. Sra. Dña. Silvia Fernández de Gurmendi, Presidente de la Asamblea; el Excmo. Sr. Juez Piotr Hofmański, Presidente del Tribunal; el Sr. D. Pasquale Velotti, Jefe Adjunto del Servicio de Asuntos Jurídicos, Controversias Diplomáticas y Acuerdo Internacional del Ministerio de Asuntos Exteriores y Cooperación Internacional de Italia; y el Sr. D. William Schabas, Relator General del Simposio, ofreció un resumen general del mismo.
Durante los dos días que duró este evento, los asistentes participaron en cuatro mesas redondas en las que pudieron reflexionar sobre las oportunidades de reforzar el ámbito penal sustantivo del Estatuto de Roma mediante la inclusión de nuevos delitos; debatieron sobre las lecciones aprendidas tras 25 años de aplicación del principio de complementariedad en la práctica y en la jurisprudencia; consideraron las perspectivas de futuro para garantizar los derechos de las víctimas a la verdad, la justicia y la reparación y un enfoque centrado en las víctimas; y reflexionaron sobre las perspectivas de futuro y los retos para la gobernanza y el funcionamiento de la Corte. Asimismo, durante el simposio los participantes recibieron una presentación sobre los Principios Éticos para los Jueces Penales Internacionales.
La Declaración adoptada al concluir el simposio reafirmó la importancia de fortalecer la Corte, alentó a los Estados Partes a cooperar con ella, recordó el principio de complementariedad y pidió la implementación efectiva del Estatuto de Roma, el fortalecimiento del marco institucional de la Corte y el sistema del Estatuto de Roma. La Declaración también condenó los actos de intimidación y ataques contra la Corte y reiteró su apoyo como tribunal de justicia independiente e imparcial, apoyando firmemente a sus funcionarios electos, su personal y todos aquellos que cooperan con ella.

احتفَلت جمعية الدول الأطراف في نظام روما الأساسي للمحكمة الجنائية الدولية ("الجمعية") في اليومَين 12 و13 تشرين الأول/ أكتوبر 2023، بالذكرى السنوية الخامسة والعشرين لاعتماد نظام روما الأساسي في مدينة سيراكوزا، إيطاليا، وذلك من خلال تنظيم ندوةٍ بعنوان "الرؤية الاستراتيجية للعَقد القادم: كيفية ضمان الدعم المستمِر والمستدام للمحكمة الجنائية الدولية". وقد نُظِّمت الندوة من قِبَل معهد سيراكوزا للعدالة الجنائية وحقوق الإنسان بدعم من الجمعية، حيث كانت هذه الندوة جزءاً من عملية الاحتفال بالذكرى السنوية الخامسة والعشرين لاعتماد نظام روما الأساسي والتي أطلقتها الجمعية في لاهاي بتاريخ 12 تموز/ يوليو وتواصلت في نيويورك في 17 تموز/ يوليو 2023، وقد حضرها كل من الدول الأطراف والدول المراقبة والمحكمة والمنظمات الدولية والإقليمية، فضلاً عن المنظمات غير الحكومية.
وفي اليوم الأول من الندوة، قام السيد جان فرانسوا طوني بإلقاء كلمة افتتاحية، رئيس معهد سيراكوزا الدولي للعدالة الجنائية وحقوق الإنسان؛ وسعادة السيدة سيلفيا فرنانديز دي غورمندي، رئيسة الجمعية؛ وسعادة القاضي بيوتر هوفمانسكي، رئيس المحكمة؛ والسيد باسكال فيلوتي، نائب رئيس دائرة الشؤون القانونية والمنازعات الدبلوماسية والاتفاقيات الدولية التابعة لوزارة الخارجية والتعاون الدولي الإيطالية. وقد قدّم السيد ويليام شاباس، المقرِّر العام للحدث، لمحةً عامةً عن الندوة.
وقد شارك الحضور في أربع حلقات نقاش خلال هذا الحدث الذي استمر لمدة يومين، حيث تحدثوا خلالها عن فرص تعزيز النطاق الجنائي الموضوعي لنظام روما الأساسي من خلال إدراج جرائم جديدة؛ وناقشوا الدروس المستفادة من 25 عاماً من تفعيل مبدأ التكامل في الممارسة والفقه القانونيَّين؛ ونظروا في الآفاق المستقبلية لضمان حقوق الضحايا في مسائل معرفة الحقيقة والعدالة والتعويض واتباع نهج يركز على الضحايا؛ وتأملوا في الآفاق والتحديات المستقبلية لإدارة المحكمة وعملها. وتم تقديم عرض للمشاركين حول المبادئ الأخلاقية للقضاة الجنائيين الدوليين خلال هذه الندوة.
وأكّد الإعلان الذي تم اعتماده في ختام الندوة على أهمية تعزيز المحكمة، وشجّع الدول الأطراف على التعاون معها، وذكّر بمبدأ التكامل، ودعا إلى التطبيق الفعّال لنظام روما الأساسي، وتعزيز الإطار المؤسسي لكل من المحكمة ونظام روما الأساسي. وأدان هذا الإعلان أعمال التخويف والهجمات ضد المحكمة، وأكّد مجدّداً على دعمه للمحكمة باعتبارها محكمة قانونية مستقلة ومحايدة، والتي تقف بحزم إلى جانب مسؤوليها وموظفيها وجميع من يتعاونون معها.
