President of the ASP statement on alleged misconduct by an ICC elected official
I am aware of recent public reports regarding alleged misconduct by the ICC Prosecutor towards a member of his Office. I can confirm that the Independent Oversight Mechanism (IOM) was seized of this matter on the basis of a third-party report.
The IOM is mandated to address such reports in an independent manner, fully respecting the rights of any persons concerned. The purpose of the IOM is to provide meaningful oversight of the Court through the conduct of independent investigations into allegations of misconduct. As a subsidiary body of the Assembly of States Parties (the Assembly), the IOM reports directly to the Assembly and exercises full operational independence from the Court.
The IOM follows a victims-centered approach in the implementation of its mandate, and therefore seeks the consent of any alleged victim of misconduct before proceeding with an investigation. The IOM did so upon being seized. As reported by the IOM in its 2023-2024 Annual Report, following the conversation with the alleged victim, the IOM was not in a position to proceed with an investigation at that stage. Measures to safeguard everyone’s rights were recommended.
The Court has a zero-tolerance policy towards prohibited conduct, such as harassment, including sexual harassment, discrimination and abuse of authority. Any reports of misconduct are taken very seriously, with full respect for the presumption of innocence, as well as the duty of care towards ICC personnel.
I remain in contact with all individuals concerned to ensure that everyone's rights continue to be safeguarded.
I ask everyone to respect the privacy of all allegedly involved individuals, as well as the integrity and confidentiality of the IOM process, including any further possible steps as necessary.
