The Presidency of the Assembly of States Parties rejects the criminal proceedings initiated against high officials of the Court
The Presidency of the Assembly of States Parties of the Rome Statute of the International Criminal Court reiterates its deep concern about the criminal proceedings initiated against the Prosecutor and the Pre-trial Judges involved in the Ukraine situation, which now have been expanded to include arrest warrants against the President, the First Vice-President, and a Trial Judge of the Court.
We reject these unacceptable acts intended to hamper the Court’s independent mandate to investigate and prosecute the perpetrators of the most serious crimes of concern to the international community as a whole. This attack against the institution, through attempted personal intimidation of its highest officials is a grave affront to the quest for accountability and to the rule of law.
As an institution of last resort, the Court is complementary to national efforts to ensure accountability for the gravest crimes. In so doing, the Court plays a key role in the pursuit of justice, which is an indispensable component of sustainable peace and security.
We reiterate our unwavering support for the International Criminal Court as an independent and impartial court of law and stand firmly by its elected officials, its personnel and all those cooperating with it. We urge all States, international organizations, and civil society to reject any threat and attack against them and to cooperate fully with the Court in order to preserve its integrity and enhance its protection, independence and impartiality.

The Assembly of States Parties is the management oversight and legislative body of the ICC. It is comprised of representatives of States that have ratified or acceded to the Rome Statute. تعبّر رئاسة جمعية الدول الأطراف في نظام روما الأساسي للمحكمة الجنائية الدولية عن بالغ قلقها إزاء الدعاوى الجنائية التي رفعها الاتحاد الروسي ضد المدّعي العام والقضاة في الشعبة التمهيدية المشاركين في قضية أوكرانيا، والتي توسّعت حتى شملت مذكرات توقيف بحق رئيس المحكمة والنائبة الأولى للمحكمة، وقاضٍ في الدائرة الابتدائية.
إننا نرفض هذه الأعمال غير المقبولة والتي تهدف إلى عرقلة الولاية المستقلة للمحكمة في التحقيق في أخطر الجرائم التي تثير قلق المجتمع الدولي بأسرِه ومقاضاة مرتكبيها. إن هذه الهجمة ضد المؤسسة من خلال محاولات التخويف الشخصي للمسؤولين فيها إنما هو إهانة خطيرة للسعي إلى المساءلة وسيادة القانون.
إن المحكمة هي محكمة الملاذ الأخير وهي مكمّلة للجهود الوطنية الرامية إلى ضمان المسائلة عن أخطر الجرائم. وبهذا تلعب المحكمة دورًا رئيسيًا في السعي إلى تحقيق العدالة وهي عنصر لا غنى عنه في تحقيق السلام والأمن المستدامين.
ونجدّد دعمنا الثابت للمحكمة الجنائية الدولية بوصفها مؤسسة قضائية مستقلة ومحايدة، ونؤيد المسؤولين في المحكمة وموظفيها والعاملين معها تأييدًا راسخًا، ونحثّ جميع الدول والمنظمات الدولية والمجتمع المدني إلى رفض كل التهديدات والهجمات الموجهة ضدّهم، وإلى التعاون تعاونًا كاملاً مع المحكمة بهدف الحفاظ على سلامتها وتعزيز حمايتها واستقلالها وحيادها.

La Presidencia de la Asamblea de los Estados Partes del Estatuto de Roma de la Corte Penal Internacional, reitera su profunda preocupación por los procesos penales iniciados contra el Fiscal y los jueces de instrucción involucrados en la situación de Ucrania, que ahora se han ampliado para incluir órdenes de captura contra el Presidente, la Primer Vicepresidenta y un Juez de Primera Instancia de la Corte.
Rechazamos estos actos inaceptables que pretenden obstaculizar el mandato independiente de la Corte de investigar y procesar a los autores de los crímenes más graves que preocupan a la comunidad internacional en su conjunto. Este ataque contra la institución, mediante un intento de intimidación personal de sus más altos funcionarios, es una grave afrenta a la búsqueda de rendición de cuentas y al Estado de derecho.
Como institución de último recurso, la Corte complementa los esfuerzos nacionales para garantizar la rendición de cuentas por los crímenes más graves. Al hacerlo, la Corte desempeña un papel clave en la búsqueda de la justicia, que es un componente indispensable de la paz y la seguridad sostenibles.
Reiteramos nuestro apoyo inquebrantable a la Corte Penal Internacional como tribunal de justicia independiente e imparcial y apoyamos firmemente a sus funcionarios electos, su personal y todos aquellos que cooperan con ella. Instamos a todos los Estados, organizaciones internacionales y la sociedad civil a rechazar cualquier amenaza y ataque contra la Corte y a cooperar plenamente con la Corte para preservar su integridad y mejorar su protección, independencia e imparcialidad.
