List of Names of Suspects in Darfur opened by the ICC OTP

In the afternoon of 7 April 2005 ICC Prosecutor Luis Moreno-Ocampo, Deputy Prosecutor (investigations) Serge Brammertz, Deputy Prosecutor (prosecutions) Fatou Bensouda and Chef de Cabinet Silvia Fernandez de Gurmendi in a meeting at the site of the ICC opened a sealed list of individuals named by the United Nations International Commission of Inquiry as suspects of grave international crimes in Darfur in Sudan.
The list includes names of 51 individuals and the reasoning for why the Commission believes they are suspects of crimes committed in Darfur. After a careful review the Prosecutor and his advisers decided to reseal the list without making copies or taking notes, in order to maintain full confidentiality. The list is advice to the Prosecutor and not mandatory for him to follow. The Office of the Prosecutor has also received the archive of the Commission and will review the documentation carefully and independently. The Prosecutor will also include information from other sources in the analysis.
Background:
The International Commission of Inquiry handed the sealed list to UN Secretary General Kofi Annan in January 2005 and on April 5 it was delivered to Chief Prosecutor Moreno-Ocampo at UN headquarters in New York. On 31 March 2005 the United Nations Security Council in resolution 1593 (2005) decided to refer the situation in Darfur to the Prosecutor of the ICC.
Before deciding whether to start an investigation Prosecutor Moreno-Ocampo is obliged under the Rome Statute of the International Criminal Court to assess the admissibility of the situation in Darfur. In the process the Prosecutor will analyze the documentation provided by the Commission of Inquiry and information obtained from other sources.
