Decision of Pre-Trial Chamber I on the Prosecutor's Request under Article 56 of the Rome Statute

Today, Tuesday 26 April 2005, Pre-Trial Chamber I rendered a decision authorising the Prosecutor to request the services of the Netherlands Forensic Institute (NFI), a Dutch specialist laboratory. This decision was taken further to a request made by the Prosecutor on 19 April, which was examined at a consultation hearing held on 21 April 2005 pursuant to rule 114 of the Rules of Procedure and Evidence.
The Chamber received assurances in this connection from the Prosecutor that his office would not be involved in any way in the analyses conducted by the independent laboratory. The appropriateness of appointing counsel to represent the general interests of the defence in relation to this measure was also discussed at the hearing.
In the wake of the consultation, the Chamber decided that, upon submission of its expert report, the NFI could be questioned by the Prosecutor and/or the ad hoc counsel for the defence to be appointed by the Registrar under the terms of the decision.
