Assembly President O-Gon Kwon welcomes the final report of the Group of Independent Experts

Today the Group of Independent Experts issued its final Report in accordance with the 30 September 2020 timeline set out in Assembly resolution ICC-ASP/18/Res.7. On 6 December 2019, the Assembly appointed nine Experts to carry out an Independent Expert Review of the International Criminal Court and the Rome Statute System. The Experts were mandated to make recommendations to the Assembly of States Parties and the Court on specific complex technical issues under the clusters Governance, Judiciary, and Investigations and prosecutions. The Assembly underlined that, for this process to be successful, it must involve all States Parties, the Court and other relevant stakeholders.

The Assembly appointed the following experts to the respective clusters: Cluster 1, Governance: Mr. Nicolas Guillou (France), Ms. Mónica Pinto (Argentina), Mr. Mike Smith (Australia); Cluster 2, Judiciary: Ms. Anna Bednarek (Poland), Mr. Iain Bonomy (United Kingdom), Mr. Mohamed Chande Othman (Tanzania); Cluster 3, Prosecution and investigation: Mr. Richard Goldstone (South Africa), Mr. Hassan Jallow (The Gambia), and Ms. Cristina Schwansee Romano (Brazil).

I commend the Chair of the IER Experts, Mr. Richard Goldstone, for leading and guiding the work of the IER review over the past nine months. I also commend the Group of Independent Experts for their commitment to continuing to carry out their mandate, despite the serious constraints imposed across the globe due to the COVID-19 pandemic shortly after they began their work. The Experts met with representatives of States Parties, Court officials and members of civil society via in-person meetings and virtual meetings during the past months and, through the Chair, briefed States Parties in the Bureau and the working groups of the Bureau on the progress of their work. They carried out their mandate fully respecting judicial and prosecutorial independence. Three Research Assistants, Ms. Gabriele Chlevickaite, Ms. Maria Manolescu and Ms. Kritika Sharma, whom I also thank, provided substantive support to the Experts.

The report contains recommendations to the Court and to the Assembly in the respective areas of study commissioned by the Assembly. The Experts emphasized that the findings in the report are focused on areas in need of improvement, rather than an exhaustive overview of all the positive aspects within the Court or of the Rome Statute system. Nothing stated in the report should in any way call into question the necessity and value of the Court. 

The Assembly will now carefully consider the IER Experts' recommendations, some of which are related to issues currently being discussed by States Parties, and will take decisions on the steps to be taken moving forward. 

On 7 October at 15:00 (Central European Time) the Experts will hold a Q&A session to respond to any queries submitted to them by the States Parties, the Court, and the civil society organisations.

It is the common goal of States Parties, the Court and civil society to ensure good governance, accountability and the effectiveness of the Court in the global fight against impunity, as well as to strengthen the Court in its mandate to end impunity for perpetrators of the most heinous crimes and bring justice to the victims. This process of review of the Court and the Rome Statue system is the most far-reaching exercise the Assembly has ever commissioned since the Court began its operations in 2002. I encourage all stakeholders to accord the report of the IER Experts the critical importance which is due to it, and to take all necessary measures to implement these concrete, achievable and actionable recommendations of the IER Experts.

Together we can achieve our common goal of strengthening the Court and the Rome Statute system.

El Grupo de Expertos Independientes ha publicado hoy su informe final de conformidad con el plazo del 30 de septiembre de 2020 establecido en la resolución ICC-ASP/18/Res.7 de la Asamblea. El 6 de diciembre de 2019, la Asamblea nombró nueve expertos para que llevaran a cabo una Revisión de Expertos Independientes de la Corte Penal Internacional y del sistema del Estatuto de Roma. Se encomendó a los expertos que formularan recomendaciones a la Asamblea de los Estados Partes y a la Corte acerca de asuntos técnicos concretos de complejidad en los siguientes grupos temáticos: gobernanza, judicatura, e investigaciones y enjuiciamientos. La Asamblea subrayó que, para que este proceso fuera fructífero, debía implicar a todos los Estados Partes, a la Corte y a otras partes interesadas pertinentes.

La Asamblea nombró a los siguientes expertos para los grupos temáticos respectivos: Grupo temático 1, Gobernanza: Sr. Nicolas Guillou (Francia), Sra. Mónica Pinto (Argentina), Sr. Mike Smith (Australia); Grupo temático 2, Judicatura: Sra. Anna Bednarek (Polonia), Sr. Iain Bonomy (Reino Unido), Sr. Mohamed Chande Othman (Tanzania); Grupo temático 3, Enjuiciamiento e investigación: Sr. Richard Goldstone (Sudáfrica), Sr. Hassan Jallow (Gambia), y Sra. Cristina Schwansee Romano (Brasil).

Felicito al Presidente del Grupo de Expertos de la Revisión de Expertos Independientes, el Sr. Richard Goldstone, por dirigir y orientar la labor de examen de la Revisión de Expertos Independientes a lo largo de los últimos nueve meses. Felicito asimismo al Grupo de Expertos Independientes por su determinación en el cumplimiento de su mandato, a pesar de las graves limitaciones impuestas en todo el mundo poco después de que comenzaran su trabajo como consecuencia de la pandemia de COVID-19. Los expertos se reunieron con representantes de los Estados Partes, funcionarios de la Corte y miembros de la sociedad civil de forma presencial y virtual en los últimos meses y, por conducto del Presidente, informaron a los Estados Partes en la Mesa y en los grupos de trabajo de la Mesa acerca de los avances en su tarea. Desempeñaron su mandato respetando plenamente la independencia judicial y fiscal. Extiendo mi agradecimiento también a los tres auxiliares de investigación, a saber: la Sra. Gabriele Chlevickaite, la Sra. Maria Manolescu y la Sra. Kritika Sharma, quienes prestaron un apoyo significativo a los expertos.

En el informe se incluyen recomendaciones dirigidas a la Corte y a la Asamblea en las respectivas áreas de estudio encargadas por la Asamblea. Los expertos insistieron en que las conclusiones del informe se centran en ámbitos que requieren mejoras, más que en una revisión exhaustiva de todos los aspectos positivos dentro de la Corte o del sistema del Estatuto de Roma. Nada de lo que figura en el informe debería, en modo alguno, cuestionar el carácter necesario y el valor de la Corte.

La Asamblea procederá ahora a examinar atentamente las recomendaciones formuladas por los expertos en su Revisión de Expertos Independientes, algunas de las cuales tienen que ver con asuntos que se están debatiendo entre los Estados Partes, y tomará decisiones acerca de los pasos necesarios de cara al futuro.

El 7 de octubre, a las 15:00 (CET, hora de Europa Central), los expertos celebrarán una sesión de preguntas y respuestas para responder cualquier duda que les planteen los Estados Partes, la Corte y las organizaciones de la sociedad civil.

Los Estados Partes, la Corte y la sociedad civil comparten el objetivo común de velar por la buena gobernanza, rendición de cuentas y eficacia de la Corte en la lucha mundial contra la impunidad, así como el de fortalecer la Corte en su cometido de poner fin a la impunidad de los autores de los crímenes más atroces y de hacer justicia a las víctimas. El presente proceso de revisión de la Corte y del sistema del Estatuto de Roma es el ejercicio más ambicioso que haya encargado nunca la Asamblea desde que la Corte comenzara a funcionar en 2002. Insto a todas las partes interesadas a que otorguen al informe de la Revisión de Expertos Independientes la importancia crucial que le corresponde, y a que adopten todas las medidas necesarias para aplicar estas recomendaciones concretas, alcanzables y viables formuladas por los expertos de la Revisión de Expertos Independientes. Juntos, podemos lograr el objetivo que compartimos de fortalecer la Corte y el sistema del Estatuto de Roma.

أصدر فريق الخبراء المستقلين اليوم تقريره النهائي وفقًا لتاريخ 30 سبتمبر/أيلول 2020 المحدد في الجدول الزمني لقرار الجمعية ICC-ASP/18/Res.7. وعينت الجمعية في 6 ديسمبر/كانون الأول 2019 تسعة خبراء لإجراء استعراض في إطار فريف الخبراء المستقلين للمحكمة الجنائية الدولية ونظام روما الأساسي. وكُلف أولئك الخبراء بتقديم توصيات إلى جمعية الدول الأطراف والمحكمة بشأن قضايا تقنية بعينها تتسم بالتعقيد في إطار مجموعات الحوكمة، والقضاء، والملاحقة القضائية والتحقيق. وشددت الجمعية على أن نجاح تلك العملية رهين بإشراك جميع الدول الأطراف والمحكمة وأصحاب المصلحة الآخرين ذوي الصلة.

وعينت الجمعية الخبراء التالية أسماؤهم في المجموعات المعنية: المجموعة 1، الحوكمة: السيد نيكولاس جيلو (فرنسا)، والسيدة مونيكا بينتو (الأرجنتين)، والسيد مايك سميث (أستراليا)؛ المجموعة 2، القضاء: السيدة آنا بيدناريك (بولندا)، السيد إيان بونومي (المملكة المتحدة)، السيد محمد شاندي عثمان (تنزانيا)؛ المجموعة 3، الملاحقة القضائية والتحقيق: السيد ريتشارد غولدستون (جنوب أفريقيا) والسيد حسن جالو (غامبيا) والسيدة كريستينا شوانسي رومانو (البرازيل).

وقال رئيس الجمعية "أُثني على رئيس فريق استعراض الخبراء المستقلين، السيد ريتشارد غولدستون، لقيادته وتوجيه عمل فريق الخبراء المستقلين خلال الأشهر التسعة الماضية. كما أُثني على فريق الخبراء المستقلين لالتزامهم بمواصلة تنفيذ ما كلفوا به، على الرغم من القيود الخطيرة المفروضة في جميع أنحاء العالم بسبب جائحة كوفيد-19 بعد وقت قصير من بدء مهمتهم. والتقى الخبراء بممثلي الدول الأطراف ومسؤولي المحاكم وأعضاء المجتمع المدني من خلال اجتماعات شخصية واجتماعات افتراضية خلال الأشهر الماضية، وأطلعوا، من خلال الرئيس، الدول الأطراف في المكتب والأفرقة العاملة التابعة للمكتب على التقدم المحرز في مهمتهم. وقد نفذوا ما كلفوا به مع الاحترام الكامل لاستقلال القضاء والنيابة العامة. كما أعرب عن شكري أيضا للمساعِدات في مجال البحوث السيدة غابرييل شليفيكايتي، والسيدة ماريا مانولسكو، والسيدة كريتيكا شارما، على تقديمهن دعمًا كبيرًا للخبراء".

ويتضمن التقرير توصيات إلى المحكمة والجمعية في مجالات الدراسة ذات الصلة التي طلبتها الجمعية. وأكد الخبراء أن النتائج الواردة في التقرير تركز على المجالات التي تحتاج إلى تحسين، بدلاً من تقديم نظرة عامة شاملة عن جميع الجوانب الإيجابية داخل المحكمة أو نظام روما الأساسي. ولا ينبغي لما سيرد في التقرير بأي حال من الأحوال أن يدعو إلى التشكيك في أهمية وقيمة المحكمة.

وستنظر الجمعية حاليا بعناية في توصيات فريق الخبراء المستقلين، والتي يرتبط بعضها بالقضايا التي تناقشها الدول الأطراف حاليًا، وستتخذ قرارات بشأن الخطوات التي يتعين اتخاذها للمضي قدمًا.

وفي 7 أكتوبر/تشرين الأول في تمام الساعة 15:00 (بتوقيت وسط أوروبا) سيعقد الخبراء جلسة أسئلة وأجوبة للرد على أي استفسارات تطرحها الدول الأطراف والمحكمة ومنظمات المجتمع المدني.

ويتمثل الهدف المشترك بين الدول الأطراف والمحكمة والمجتمع المدني في ضمان الحوكمة الرشيدة والمساءلة وفعالية المحكمة في الكفاح العالمي ضد الإفلات من العقاب، فضلاً عن تعزيز المحكمة في مهمتها لوضع حد لإفلات مرتكبي أبشع الجرائم من العقاب وتحقيق العدالة للضحايا. وتُعد عملية استعراض المحكمة ونظام روما الأساسي هي العملية الأكثر شمولاً التي أسندتها الجمعية على الإطلاق منذ أن بدأت المحكمة عملياتها في عام 2002. وأشجع جميع أصحاب المصلحة على إعطاء تقرير فريق الخبراء المستقلين الأهمية البالغة التي يستحقها، واتخاذ جميع التدابير اللازمة لتنفيذ تلك التوصيات الملموسة والقابلة للتحقيق والقابلة للتنفيذ الصادرة عن فريق الخبراء المستقلين. ويمكننا معا تحقيق هدفنا المشترك المتمثل في تعزيز المحكمة ونظام روما الأساسي.
