Argentina and International Criminal Court sign an agreement on Witnesses’ protection
On 21 November 2016, at the seat of the International Criminal Court ("ICC" or "the Court"), the Ambassador of the Argentine Republic to the Kingdom of The Netherlands, H.E. Mr Horacio Salvador, and the ICC Registrar, Mr Herman von Hebel signed a cooperation agreement related to witnesses' protection in the presence of the ICC President, Judge Silvia Fernández de Gurmendi, and the Under Secretary for Criminal Policy of the Ministry of Justice of Argentina, Dr Ricardo Martín Casares.
The President of the Court thanked the Argentine Republic for renewing in concrete terms its willingness to cooperate with the Court. "The signing of agreements greatly facilitates cooperation between the Court and a State Party. […] When, in exceptional cases, the lives of witnesses are in danger, the Court needs the cooperation of States to ensure that they do not suffer any harm because of their testimony", she stressed.
The Ambassador of the Argentine Republic stated that "the signing of this Agreement reaffirms Argentina´s commitment on matters of cooperation with the ICC" and added that his country "will continue to give support to the Court in the fight against impunity of the most serious crimes of international concern".
The Registrar of the Court further noted that cooperation agreements, and in particular regarding witnesses' protection, are a key priority for the Court. He indicated that the signature of this agreement brought the number of such agreements to 18 and added: "We call on more States Parties to consider signing these agreements. The Registry stands ready to engage with all interested States on this key matter for the Court. The Seminar hosted by the ICC this Friday, 25 November and dedicated to cooperation agreements is a good opportunity to foster stronger and operational cooperation ties with the ICC".
The ICC offers protection to persons at risk because of their engagement with the Court. Agreements on witnesses' protection are in principle confidential, unless the State decides otherwise, and are necessary to ensure the success of this protection and to allow witnesses to safely present their testimonies to the ICC Judges.

El 21 de noviembre de 2016, en la sede de la Corte Penal Internacional ("CPI" o "la Corte"), S.E. el Embajador de la República Argentina ante el Reino de los Países Bajos, el Sr. Horacio Salvador, y el Secretario de la Corte Penal Internacional, el Sr. Herman von Hebel, firmaron un acuerdo de cooperación en el área de la protección de testigos, en presencia de la Presidenta de la CPI, Sra. Silvia Fernández de Gurmendi y el Subsecretario de Política Criminal del Ministerio de Justicia de Argentina, Dr. Ricardo Martín Casares.
La Presidenta de la Corte agradeció a la República Argentina la renovación en términos concretos de su voluntad de cooperar con la Corte. "La firma de acuerdos facilita enormemente la cooperación entre la Corte y un Estado Parte. [...] Cuando, en casos excepcionales, la vida de los testigos está en peligro, la Corte necesita la cooperación de los Estados para asegurar que no sufran ningún daño como debido a su testimonio", subrayó.
S.E. el Embajador de la República Argentina dijo que "la firma de este Acuerdo reafirma el compromiso de la Argentina en materia de cooperación con la CPI" y que su país "continuará brindándole su apoyo en su lucha contra la impunidad de los crímenes más graves de trascendencia internacional".
Asimismo el Secretario de la Corte señaló que los acuerdos de cooperación y, en particular, la protección a lostestigos, constituyen una prioridad para la Corte, Indicó que con la firma de este acuerdo se elevó a 18 el número de acuerdos similares y añadió: "instamos a otros Estados Partes a considerar la posibilidad de firmar estos acuerdos. La Secretaría está dispuesta a colaborar con todos los Estados interesados en esta cuestión clave para la Corte. El seminario organizado por la CPI este viernes 25 de noviembre y dedicado a los acuerdos de cooperación es una buena oportunidad para fomentar vínculos de cooperación operativa más fuerte".
La CPI ofrece protección a las personas en situación de riesgo debido a su colaboración con la Corte. Los acuerdos de cooperaciónen el área de la protección de testigos son en principio confidenciales, salvo que el Estado decida lo contrario, y son necesarios para asegurar el éxito de esta protección y permitir que los testigos presenten su testimonio de manera segura ante los jueces de la CPI.
