Al Hassan case: ICC Pre-Trial Chamber I accepts amendments to the charges
Today, 23 April 2020, Pre-Trial Chamber I of the International Criminal Court ("ICC" or "the Court") issued a confidential decision partially granting the Prosecutor's request to modify the charges against Al Hassan Ag Abdoul Aziz Ag Mohamed Ag Mahmoud (Mr Al Hassan). A redacted version of this decision will be made public later. [NB: The redacted version of this decision was made public on 11 May 2020.]
In its decision, the Chamber decided to include in the charges already confirmed against Mr. Al Hassan additional facts for which there are substantial grounds to believe that he would be responsible for.
Thus, the following charges of crimes against humanity are modified to include additional facts: sexual slavery, rape, persecution and other inhuman acts, including forced marriage; as well as the following charges of war crimes: cruel treatment, sexual slavery, rape, outrages upon personal dignity and passing of sentences without previous judgement pronounced by a regularly constituted court affording all judicial guarantees which are generally recognized as indispensable. The other requests by the Prosecutor were dismissed.
Background: The warrant of arrest for Al Hassan Ag Abdoul Aziz Ag Mohamed Ag Mahmoud was issued on 27 March 2018. He was surrendered to the ICC on 31 March 2018. He is in the Court's custody. The confirmation of charges hearing took place from 8 to 17 July 2019. On 30 September 2019, Pre-Trial Chamber I issued a confidential decision confirming the charges of war crimes and crimes against humanity brought by the Prosecutor against Mr Al Hassan and committed him to trial. The redacted version of the decision was published on 13 November 2019. On 21 November 2019, Trial Chamber X was constituted and will be responsible for conducting the trial in the Al Hassan case. The trial is scheduled to open on 14 July 2020.

أصدرت الدائرة التمهيدية الأولى في المحكمة الجنائية الدولية (''المحكمة'') اليوم، 23 نيسان/أبريل 2020، قراراً سرياً يستجيب جزئياً لطلب المدعية العامة إدخال تعديلات على التهم الموجهة ضد الحسن أغ عبد العزيز أغ محمد أغ محمود ("السيد الحسن"). وستَصدُر نسخة محجوبة منها معلومات من هذا القرار لاحقاً.
وقضت الدائرة في قرارها بضم مزيد من الوقائع في التهم المعتمدة ضد السيد الحسن، وذلك لأسباب جوهرية تدعو للاعتقاد بمسؤوليته عن تلك الوقائع.
وعليه، فقد أضيفت وقائع أخرى في تهم ارتكاب الجرائم ضد الإنسانية الآتي ذكرها: الاستعباد الجنسي، والاغتصاب، والاضطهاد، وأعمال لاإنسانية أخرى، منها الزواج القسري، إلى جانب تهم ارتكاب جرائم الحرب التالية: المعاملة القاسية، والاستعباد الجنسي، والاغتصاب، والاعتداء على كرامة الأشخاص، وإصدار عقوبات دون حكم سابق صادر عن محكمة مشكلة تشكيلاً نظامياً تكفل جميع الضمانات القضائية المعترف عموما بأنه لا غنى عنها، بينما طُرحت بقية الطلبات التي تقدمت بها المدعية العامة.
معلومات أساسية: صدر أمر القبض على الحسن أغ عبد العزيز أغ محمد أغ محمود في 27 آذار/مارس 2018، وتم تقديمه إلى المحكمة في 31 من الشهر نفسه، وهو محتجز لدى المحكمة. وانعقدت جلسة اعتماد التهم من 8 إلى 17 تموز/يوليو 2019. وفي 30 أيلول/سبتمبر 2019، أصدرت الدائرة التمهيدية الأولى قراراً سرياً باعتماد التهم في جرائم الحرب والجرائم ضد الإنسانية التي نسبتها إليه المدعية العامة، وأُحيل بذلك إلى المحاكمة. ثم نُشرت نسخة محجوبة منها معلومات من القرار في 13 تشرين الثاني/نوفمبر 2019. وفي 21 تشرين الثاني/نوفمبر 2019، تشكلت الدائرة الابتدائية العاشرة، التي ستتولى إجراء المحاكمة في قضية الحسن المزمع بدؤها في 14 تموز/يوليو 2020.
