Abd–Al-Rahman case: Confirmation of charges hearing postponed to 22 February 2021
Today, 2 November 2020, Pre-Trial Chamber II of the International Criminal Court (ICC) decided to postpone the commencement of the confirmation hearing in the case The Prosecutor v. Ali Muhammad Ali Abd-Al-Rahman to Monday, 22 February 2021. The hearing was initially scheduled to take place on 7 December 2020.
Having considered the parties' submissions and arguments and taken into account the overall fairness and expeditiousness of the proceedings, the rights of the suspect, the protection of victims, witnesses and other persons at risk, and the circumstances of the case, in view of ensuring the safety and overall security of victims and witnesses, the Chamber considered it appropriate to postpone the confirmation of charges hearing to 22 February 2021. The Chamber also set a number of deadlines for the disclosure of evidence by the Prosecutor.
The purpose of the confirmation of charges hearing is to determine whether there is sufficient evidence to establish substantial grounds to believe that the person committed each of the crimes charged. If the charges are confirmed, the case will be transferred to a Trial Chamber, which will conduct the subsequent phase of the proceedings: the trial.
Background: The first warrant of arrest delivered on 27 April 2007 and the second warrant published on 11 June 2020 against Mr Abd–Al-Rahman list 53 counts on the basis of his individual criminal responsibility for war crimes and crimes against humanity allegedly committed in Darfur (Sudan). Mr Abd-Al-Rahman was transferred to the ICC's custody on 9 June 2020, after surrendering himself voluntarily in the Central African Republic. His initial appearance before the ICC took place on 15 June 2020.

اليوم، 2 تشرين الثاني/نوفمبر 2020، قررت الدائرة التمهيدية الثانية للمحكمة الجنائية الدولية تأجيل بدء جلسة اعتماد التهم في قضية المدعي العام ضد علي محمد علي عبد الرحمن حتى الاثنين، 22 شباط/فبراير 2021. وكان من المقرر عقد الجلسة أصلا في 7 كانون الأول/ديسمبر 2020.
وبعد النظر في مذكرات الأطراف وحججهم ومراعاة اعتبارات الإنصاف العامة وسرعة الإجراءات، وحقوق المشتبه فيه، وحماية المجني عليهم والشهود والأشخاص الآخرين المعرضين للخطر، وظروف القضية، بغية ضمان سلامة المجني عليهم والشهود وأمنهم بشكل عام، ارتأت الدائرة أن من الملائم تأجيل جلسة اعتماد التهم إلى 22 شباط/فبراير 2021. كما حددت الدائرة عددًا من الآجال لقيام المدعي العام بالكشف عن الأدلة.
والغرض من جلسة اعتماد التهم هو تحديد ما إذا كانت ثمة ما يكفي من الأدلة لإثبات وجود أسباب جوهرية للاعتقاد بأن الشخص قد ارتكب كل جريمة من الجرائم المتهم بها. وإذا اعتُمِدت التهم، ستحال القضية إلى الدائرة الابتدائية، التي ستجري المرحلة اللاحقة من الإجراءات: أي المحاكمة.

أول أمر بالقبض في 27 نيسان/أبريل 2007 وأورد الأمر الثاني بالقبض على السيد عبد الرحمن المنشور بتاريخ 11 حزيران/يونيو 2020، قائمة تضم 53 تهمة تستند إلى مسؤوليته الجنائية الفردية عن ارتكاب جرائم حرب وجرائم ضد الإنسانية يُدَّعى أنها ارتُكبت في دارفور (السودان). وقد نُقل السيد عبد الرحمن (علي كوشيب) إلى عُهدة المحكمة الجنائية الدولية في 9 حزيران/يونيه 2020، بعد أن سلم نفسه طواعية في جمهورية إفريقيا الوسطى. ومَثُلَ أمام المحكمة الجنائية الدولية مثولا أوليا في 15 حزيران/يونيه 2020.
