Statement of ICC Prosecutor, Karim A.A. Khan QC, on completion of second visit to Venezuela: “Through cooperation we will accelerate our common work towards justice.”

Today, I completed my second official visit to the Bolivarian Republic of Venezuela, during which significant steps have been taken to deepen cooperation and accelerate our independent work in relation to the Situation in Venezuela following my decision to open an investigation in November 2021.

I express my gratitude to the authorities of Venezuela for their official invitation and for their cooperative consultations with my delegation.  I am grateful in particular for the continued engagement of the President of the Republic, H.E. Mr Nicolás Maduro Moros with who I held straightforward and productive discussions.

The Government of Venezuela remains of the view that the conditions for an investigation have not been met. I therefore continue to consider it to their great credit that they have committed to strengthen cooperation with my Office in order that we can get to the truth.

This collaborative approach has led to concrete progress during my visit in implementation of the Memorandum of Understanding between my Office and the Government of Venezuela, signed during my last visit to Caracas in November 2021 ("MOU"). This includes authorisation for the Office of the Prosecutor to establish an office in Caracas in support of cooperation with Venezuelan authorities and facilitation of technical assistance under the framework of the MOU.

I also welcome the tangible steps that we have taken which will allow my Office to strengthen its work with respect to the Situation in Venezuela, including agreement on regular and structured technical-level engagements between my Office and Venezuelan State officials; the issuance by the Government of Venezuela of multiple entry visas to nominated members of my Office; and the nomination of legal and operational focal points to facilitate effective responses to requests for international cooperation and judicial assistance pursuant to the exercise of my independent mandate.

In November, I noted that the opening of an investigation is not a one-way street, it should also be a basis for deepening engagement and strengthening partnerships.  In this regard, I believe we have reached a significant agreement with the Government of Venezuela to work together with international partners, including the Office of the United Nations High Commissioner for Human Rights, on appropriate measures to facilitate implementation of the commitments set out in MoU.

This will include the provision of technical assistance and knowledge transfer to domestic authorities in Venezuela to support the effective investigation and prosecution at the national level of alleged crimes, and the provision of training and expert advice in order to strengthen implementation of relevant domestic legislation. Assistance will also be provided to Venezuelan authorities in identifying additional areas in which institutional or legislative frameworks may be enhanced in order to strengthen the ability of competent domestic authorities to ensure the effective administration of justice.

Contingent on the progress made in implementation of the MOU, we have also agreed that my Office and the Government of Venezuela will work towards the organisation of meetings and conferences on international criminal justice in Caracas in 2023 aimed at promoting the exchange of experiences and best practices among States of the region.

Since I took office as Prosecutor in nine months ago, I have underlined my commitment to give life to the principle of complementarity that lies at the heart of the Rome Statute.  I am convinced that efforts to deepen cooperation and build common ground across all actors, whether national authorities, survivor groups, civil society or international organisations, can only serve to strengthen the basis on which effective investigations may be conducted, allowing us to collectively forge a path towards justice.

This of course includes ensuring full respect for the right of national authorities to exercise their jurisdiction to deliver accountability in a manner consistent with national law and the principles of the Rome Statute.

As my Office moves forward with its work in relation to the Situation in Venezuela, we will continue to seek all opportunities to strengthen the partnerships with all actors pursuant to the values and principles of the Rome Statute.

Hoy concluyó mi segunda visita oficial a la República Bolivariana de Venezuela, en el curso de la cual se han adoptado medidas importantes para profundizar la cooperación y acelerar nuestra labor independiente centrada en la situación en Venezuela tras mi decisión, tomada en noviembre de 2021, de abrir una investigación.

Deseo trasmitir mi gratitud a las autoridades de Venezuela por su invitación oficial y por las consultas de cooperación mantenidas con mi delegación. En particular, estoy agradecido al Excmo. Sr. Nicolás Maduro Moros, Presidente de la República, por haber facilitado el contacto permanente, gracias al cual pude mantener con él deliberaciones directas y productivas.

El Gobierno de Venezuela sigue opinando que no se cumplen las condiciones para abrir una investigación; por eso me sigue pareciendo que dice mucho en su favor que se haya comprometido a fortalecer la cooperación con mi Fiscalía para que podamos averiguar la verdad.

Este enfoque de colaboración permitió registrar durante mi visita avances concretos en el cumplimiento del Memorándum de Entendimiento entre mi Fiscalía y el Gobierno de Venezuela, firmado en noviembre de 2021 durante mi anterior visita a Caracas. Ejemplo de ello es la autorización concedida para que la Fiscalía abra en Caracas una oficina de apoyo a la cooperación con las autoridades venezolanas y facilitación de asistencia técnica en el marco del Memorándum de Entendimiento.

También celebro las medidas tangibles que hemos adoptado, en virtud de las cuales mi Fiscalía podrá fortalecer su labor en relación con la situación en Venezuela, en particular gracias a un acuerdo para que mi Fiscalía y funcionarios estatales venezolanos mantengan contactos periódicos y estructurados de carácter técnico, la expedición por el Gobierno de Venezuela a los miembros de mi Fiscalía designados de visados de entradas múltiples en el país y el nombramiento de coordinadores jurídicos y operacionales para facilitar la respuesta eficaz a las solicitudes de cooperación internacional y asistencia judicial en el marco del ejercicio de mi mandato independiente.

En noviembre señalé que la apertura de una investigación no es un camino de dirección única, sino un fundamento para profundizar los contactos y fortalecer las asociaciones. Al respecto, considero que hemos llegado con el Gobierno de Venezuela a un acuerdo importante a efectos de colaborar con asociados internacionales, entre ellos la Oficina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos, en la adopción de medidas apropiadas para facilitar el cumplimiento de los compromisos expuestos en el Memorándum de Entendimiento.

En ese sentido, se prestará asistencia técnica y se transferirán conocimientos a las autoridades nacionales de Venezuela para prestar apoyo a la investigación y el enjuiciamiento de los presuntos crímenes a escala nacional y se impartirá capacitación y asesoramiento especializado para reforzar la aplicación de la legislación interna pertinente. También se facilitará a las autoridades venezolanas asistencia para determinar otros ámbitos en los que pueden mejorarse los marcos institucionales o legislativos para fortalecer la capacidad de las autoridades nacionales competentes a fin de garantizar una administración de justicia eficaz.

En función de los avances que se registren en el cumplimiento del Memorándum de Entendimiento, también hemos acordado que mi Fiscalía y el Gobierno de Venezuela colaboren en la organización en Caracas en 2023 de reuniones y conferencias sobre justicia penal internacional dirigidas a promover el intercambio de experiencias y mejores prácticas entre los Estados de la región.

Desde que asumí el cargo de Fiscal hace nueve meses, he recalcado mi voluntad de dar vida al principio de complementariedad que ocupa un lugar central en el Estatuto de Roma. Tengo la certeza de que la labor de profundización en la cooperación y de creación de un espacio común a todos los interesados, ya sean autoridades nacionales, grupos de supervivientes, la sociedad civil u organizaciones internacionales, solo puede contribuir a fortalecer el fundamento necesario para realizar investigaciones eficaces, lo cual nos permite abrir juntos un camino que conduce a la justicia.

Ello supone, naturalmente, garantizar el pleno respeto del derecho de las autoridades nacionales a ejercer su competencia a efectos de practicar la rendición de cuentas de conformidad con el derecho nacional y con los principios del Estatuto de Roma.

A medida que mi Fiscalía avance en su labor correspondiente a la situación en Venezuela, seguiremos buscando oportunidades de todo tipo para estrechar las asociaciones con todos los interesados con arreglo a los valores y principios del Estatuto de Roma.
