President of Palestine, H.E. Mr Mahmoud Abbas visits the ICC Prosecutor
Today, Friday 30 October 2015, the Prosecutor of the International Criminal ("ICC" or the "Court"), Mrs Fatou Bensouda and representatives of her Office received H.E. Mr Mahmoud Abbas, the President of Palestine and his delegation at the Seat of the Court in The Hague, Netherlands. The meeting was held in the margins of President Abbas' official visit to the Kingdom of The Netherlands.
Referring to the recent escalation of tensions in Israel and Palestine, the Prosecutor stressed the need for calm and restraint from all sides, and an end to the violence. She underscored that innocent people have been injured and killed on both sides, and cautioned that the situation may further degenerate into a large-scale commission of crimes that may fall within the jurisdiction of the ICC.
The Prosecutor opened a preliminary examination of the situation in Palestine in January 2015. In this context, the Prosecutor stated that her Office will also examine whether any of the newly reported incidents of violence constitute crimes falling within the jurisdiction of the ICC, and for the same purpose, will continue to record any new instances of violence or incitement to violence that may occur in the future. She warned that anyone – on either side – who commits, orders, incites, encourages or contributes in any other way to the commission of crimes falling within the jurisdiction of the ICC is liable to prosecution either at the national level or at the Court.
The Office of the Prosecutor of the ICC conducts independent and impartial preliminary examinations, investigations and prosecution of the crimes of genocide, crimes against humanity and war crimes. The Office of the Prosecutor has opened investigations in: Uganda; Democratic Republic of the Congo; Darfur, Sudan; Central African Republic; Kenya; Libya; Côte d'Ivoire and Mali. The Office is also conducting preliminary examinations relating to the situations in Afghanistan, Colombia, Georgia, Guinea, Iraq/UK, Nigeria, Ukraine and Palestine.

اليوم، الجمعة 30 تشرين الأول/اكتوبر 2015، تلقت السيدة فاتو بنسودا، المدعية العامة للمحكمة الجنائية الدولية، برفقة عدد من الممثلين عن مكتبها زيارة سعادة رئيس فلسطين السيد محمود عباس والوفد المصاحب له، في مقر المحكمة في لاهاي. وأتى هذا اللقاء على هامش الزيارة الرسمية التي يقوم بها الرئيس عباس إلى مملكة هولندا.
وبالإشارة إلى التصعيد الراهن لأعمال العنف في اسرائيل وفي فلسطين، شددت المدعية العامة على أهمية الهدوء وضبط النفس من جانب جميع الأطراف وضرورة وقف العنف. كما شددت على أن أشخاصاً أبرياء قد أصيبوا أو قتلوا من الجانبين، وحذّرت من تفاقم الوضع في شكل يؤدي إلى ارتكاب جرائم على نطاق واسع يشملها اختصاص المحكمة.
وكانت المدعية العامة قد فتحت، في كانون الثاني/يناير 2015، تحليلاً أولياً للحالة في فلسطين. وفي هذا الإطار، اعلنت المدعية العامة ان مكتبها سينظر أيضاً ما إذا كانت الأحداث المشار إليها مؤخراً تشكل جرائم خاضعة لاختصاص المحكمة الجنائية الدولية، ولغرض التحليل عينه فإنها ستستمر في تسجيل اية حالة عنف أو تحريض عليه في المستقبل. وحذرت من ان كل شخص، أياً يكن انتماؤه، يمكن أن يخضع للملاحقة على المستوى الوطني أو امام المحكمة الجنائية الدولية إذا ما ارتكب او أمر بارتكاب جرائم خاضعة لاختصاص المحكمة أو حرض او شجع عليها أو ساهم بأية طريقة أخرى في ارتكابها.
ويجري مكتب المدعي العام تحليلات أولية وتحقيقات وملاحقات في شأن جرائم الإبادة الجماعية وجرائم الحرب والجرائم ضد الإنسانية بكل استقلالية وبحياد تام. ويتابع حالياً تحقيقاته في أوغندا وجمهورية الكونغو الديمقراطية ودارفور (السودان) وجمهورية افريقيا الوسطى وكينيا وليبيا وساحل العاج ومالي. كما يجري تحليلات اولية في شأن الحالات في افغانستان وكولومبيا وجورجيا وغينيا والعراق (في ما يتعلق بجنود بريطانيين) ونيجيريا واوكرانيا وفلسطين.
