Statement of the Prosecutor of the International Criminal Court, Fatou Bensouda, on the conclusion of her visit to Colombia (10-13 September 2017)
Today, I concluded my first visit to Bogota in the context of the on-going preliminary examination of the situation in Colombia. The purpose of this visit was to obtain clarifications on certain aspects of the future Special Jurisdiction for Peace ("SJP"), as well as information about the status of relevant national proceedings relating to extrajudicial killings of civilians known as "false positives", sexual and gender-based crimes and forced displacement.
I would like to express my gratitude to the Government of Colombia for providing its support to this visit and facilitating the meetings with national authorities. During these three days, I had constructive exchanges with senior officials from the executive and the judiciary, including HE President Santos Calderón, the President of Colombia; the Minister of Justice; the Presidents of the Constitutional Court of the State Council and of the Supreme Court, as well as the Executive-Secretary of the SJP. I also benefited from the opportunity to meet with the Attorney General where I stressed the importance of receiving concrete and specific information on investigative steps taken with respect to the potential cases identified by my Office.
Finally, I am very grateful to representatives of Colombian civil society organisations for engaging with me during this visit. I have listened carefully to their views and concerns, which will continue to inform my assessment of the situation.
The implementation of the historic peace agreement concluded between the Colombian government and the Revolutionary Armed Forces of Colombia – People's Army ("FARC-EP") enters a decisive stage. In this context, I was impressed by the commitment, invaluable experience and high standards of Colombian courts. Their determination to ensure genuine accountability for the most serious crimes and respect for the rights of victims will be essential to overcome the challenges in implementing the Comprehensive System of Truth, Justice, Reparation and Non-Repetition called for by the peace agreement.
In concluding my visit, I would like to restate my Office's disposition to act, within my mandate under the Rome Statute, as a good faith partner of the Colombian government and the Colombian people in this journey towards sustainable peace.
The Office of the Prosecutor of the ICC conducts independent and impartial preliminary examinations, investigations and prosecution of the crimes of genocide, crimes against humanity and war crimes. The Office has been conducting investigations in: Uganda; the Democratic Republic of the Congo; Darfur, Sudan; the Central African Republic (two separate investigations); Kenya; Libya; Côte d'Ivoire, Mali and Georgia. The Office is also conducting preliminary examinations relating to the situations in Afghanistan; Burundi; the registered vessels of Comoros, Greece and Cambodia; Colombia; Gabon; Guinea; Iraq/UK; Palestine, Nigeria and Ukraine.

Hoy concluyó mi primera visita a Bogotá en el contexto del examen preliminar en curso sobre la situación en Colombia. La visita tenía por objeto recabar aclaraciones sobre determinados aspectos de la Jurisdicción Especial para la Paz (JEP), así como información sobre el estado de los procedimientos nacionales correspondientes a las ejecuciones extrajudiciales de civiles, conocidas como "falsos positivos", los delitos sexuales y de género y los desplazamientos forzados.
Quiero manifestar mi agradecimiento al Gobierno de Colombia por haber prestado apoyo a esta visita y facilitado las reuniones celebradas con autoridades nacionales. Durante estos tres días, he mantenido intercambios constructivos con altos funcionarios de los poderes ejecutivo y judicial, entre ellos, Su Excelencia el Sr. J.M. Presidente Santos Calderón, el Presidente de Colombia; el Ministro de Justicia; los Presidentes de la Corte Constitucional, del Consejo de Estado y de la Corte Suprema; y el Secretario Ejecutivo de la JEP. También tuve oportunidad de reunirme con el Fiscal General y recalqué la importancia de recibir información concreta y específica sobre las medidas de investigación adoptadas en relación con los posibles casos identificados por mi Fiscalía. Por último, estoy muy agradecida a los representantes de las organizaciones de la sociedad civil colombiana por los intercambios mantenidos conmigo durante la visita. He escuchado atentamente sus opiniones y sus preocupaciones, en las que seguiré basando mi evaluación de la situación.
La implementación del histórico acuerdo de paz concertado entre el Gobierno de Colombia y las Fuerzas Armadas Revolucionarias de Colombia – Ejército del Pueblo (FARC-EP) se encuentra en una etapa decisiva. En este contexto, me impresionaron el compromiso, la inestimable experiencia y los altos estándares de los tribunales colombianos. Su empeño por garantizar una rendición de cuentas genuina en relación con los crímenes más graves, así como el respeto de los derechos de las víctimas, será esencial para sortear las dificultades que rodean a la implementación del Sistema Integral de Verdad, Justicia, Reparación y No Repetición propugnado en el acuerdo de paz.
Al término de mi visita, deseo reiterar que mi Fiscalía está dispuesta a actuar, en el marco del mandato que me encomienda el Estatuto de Roma, como asociado de buena fe del Gobierno de Colombia y del pueblo colombiano en el camino que lleva a una paz sostenible.
La Fiscalía de la CPI realiza exámenes preliminares, investigaciones y enjuiciamientos independientes e imparciales de los crímenes de genocidio y lesa humanidad y crímenes de guerra. La Fiscalía ha llevado a cabo investigaciones en Uganda; la República Democrática del Congo; Darfur (Sudán); la República Centroafricana (dos investigaciones distintas); Kenya; Libia; Côte d´Ivoire; Malí; y Georgia. También lleva a cabo exámenes preliminares en torno a las situaciones en el Afganistán; Burundi; las embarcaciones registradas en las Comoras, Grecia y Camboya; Colombia; el Gabón; Guinea; Iraq/Reino Unido; Palestina; Nigeria; y Ucrania.
