Statement by the Presidency of the Assembly of States Parties in support of the independence and impartiality of the International Criminal Court
The Presidency of the Assembly of States Parties to the Rome Statute expresses concern over the recent public statements related to an ongoing International Criminal Court investigation in the situation in the State of Palestine. The Presidency regrets any attempts to undermine the Court’s independence, integrity and impartiality. Some statements may constitute threats of retaliation against the Court and its officials, in the event the Court exercises its judicial functions as mandated in the Rome Statute.
Prosecutorial and judicial independence is one of the key components of the rule of law. We call on all States to respect the independence and impartiality of the International Criminal Court.
We reiterate our firm commitment to uphold and defend the principles and values enshrined in the Rome Statute and to preserve its integrity undeterred by any threats or measures against the Court, its officials and those cooperating with it. The Rome Statute establishing the International Criminal Court was the result of thorough, transparent and inclusive negotiations involving all States. It represents an international commitment to end impunity for the most serious international crimes that threaten peace, security and the well-being of the world. The Court has a critical mandate of holding accountable perpetrators of such crimes and delivering justice to victims equally.
The Presidency stands firmly by the International Criminal Court, its elected officials, its personnel, and those cooperating with the Court. Safeguarding the Court’s integrity, including its judicial and prosecutorial independence, is fundamental to the successful discharge of its mandate. We stress the importance of the International Criminal Court as an independent and impartial court of law.
The Assembly of States Parties is the management oversight and legislative body of the International Criminal Court. It is comprised of representatives of States that have ratified or acceded to the Rome Statute. The Presidency of the Assembly is currently composed of H.E. Ms. Päivi Kaukoranta (Finland), President; H.E. Mr. Michael Imran Kanu (Sierra Leone), Vice-President; and H.E. Ms. Margareta Kassangana (Poland), Vice-President.
La Presidencia de la Asamblea de los Estados Partes del Estatuto de Roma expresa su preocupación por las recientes declaraciones públicas relacionadas con una investigación en curso de la Corte Penal Internacional en relación con la situación del estado de Palestina. La Presidencia lamenta cualquier intento de socavar la independencia, integridad e imparcialidad de la Corte. Ciertas declaraciones pueden constituir amenazas de represalias contra la Corte y sus funcionarios, en caso de que la Corte ejerza sus funciones judiciales según lo dispuesto en el Estatuto de Roma.
La independencia fiscal y judicial es uno de los componentes fundamentales del estado de derecho. Pedimos a todos los Estados que respeten la independencia y la imparcialidad de la Corte Penal Internacional.
Reiteramos nuestro firme compromiso de respaldar y defender los principios y valores consagrados en el Estatuto de Roma y de preservar su integridad sin dejarnos amilanar por las amenazas o medidas contra la Corte, sus funcionarios y quienes colaboran con ella. El Estatuto de Roma por el que se estableció la Corte Penal Internacional fue el resultado de negociaciones exhaustivas, transparentes e inclusivas en las que participaron todos los Estados. Asimismo, representa un compromiso internacional para acabar con la impunidad de los crímenes internacionales más graves que amenazan la paz, la seguridad y el bienestar del mundo. La Corte tiene el mandato fundamental de exigir responsabilidades a los autores de estos crímenes y hacer justicia a las víctimas por igual.
La Presidencia apoya de manera inquebrantable a la Corte Penal Internacional, a sus funcionarios electos, a sus funcionarios y quienes colaboran con la Corte. Para cumplir con éxito su mandato, salvaguardar la integridad de la Corte, incluida su independencia judicial y procesal, resulta fundamental. Insistimos en la importancia de la Corte Penal Internacional como tribunal de justicia independiente e imparcial.
La Asamblea de los Estados Partes es el órgano legislativo y de supervisión de la Corte Penal Internacional. Está compuesto por representantes de los Estados que han ratificado o se han adherido al Estatuto de Roma. La Presidencia de la Asamblea está compuesta actualmente por S.E. Sra. Päivi Kaukoranta (Finlandia), Presidenta; y S.E. Sr. Michael Imran Kanu (Sierra Leona) y S.E. Sra. Margareta Kassangana (Polonia), Vicepresidentes.
تعرب رئاسة جمعية الدول الأطراف في نظام روما الأساسي عن قلقها إزاء التصريحات العلنية الأخيرة المتعلقة بالتحقيق الجاري الذي تقوم به المحكمة الجنائية الدولية حول الوضع في دولة فلسطين. وتأسف الرئاسة للمحاولات الرامية إلى تقويض استقلالية المحكمة ونزاهتها وحيادها، ذلك أن بعض هذه التصريحات يعتبر تهديداً بالانتقام موجهاً ضد المحكمة ومسؤوليها في حال ممارسة هذه الأخيرة لوظائفها القضائية على النحو المنصوص عليه في نظام روما الأساسي.
ولأن استقلال النيابة العامة والقضاء عنصراً أساسياً لسيادة القانون، ندعو الدول كافة لاحترام استقلالية المحكمة الجنائية الدولية ونزاهتها.
ونكرر التزامنا الراسخ بدعم المبادئ والقيم المنصوص عنها في نظام روما الأساسي والدفاع عنها والحفاظ على نزاهتها فلا تشكل التهديدات والتدابير التي قد تتخذ ضد المحكمة ومسؤوليها والمتعاونين معها رادعاً يمنعها عن الاضطلاع بمهامها. زد إلى ذلك أن نظام روما الأساسي الذي أنشأ المحكمة الجنائية الدولية هو خلاصة مفاوضات شفافة وشاملة شاركت فيها الدول كافة، وهو يمثل التزاماً دولياً بوضع حد لمسألة الإفلات من العقاب على أخطر الجرائم الدولية التي تهدد سلم العالم وأمنه ورفاهه، وعليه تتمتع المحكمة بولاية حاسمة تقوم على محاسبة مرتكبي هذه الجرائم وتحقيق العدالة للضحايا على حد سواء.
وتساند الرئاسةُ المحكمةَ الجنائية الدولية، ومسؤوليها المنتخبين وموظفيها والمتعاونين معها مساندة راسخة، وتعتبر الحفاظ على نزاهة المحكمة ومن ضمنها استقلالية القضاء والنيابة العامة أمراً جوهرياً لنجاح ولايتها، ولذا نشدد على أهمية المحكمة الجنائية الدولية باعتبارها محكمة قانونية مستقلة وحيادية.
إن جمعية الدول الأطراف هي الهيئة الرقابية الإدارية والتشريعية للمحكمة الجنائية الدولية. وهي تتألف من ممثلي الدول التي صدقت على نظام روما الأساسي أو انضمت إليه. وتتكون رئاسة الجمعية حاليا من معالي السيدة پايفي كاوكورانتا من فنلندا بصفتها رئيسة الجمعية، معالي السيد مايكل عمران كانو من سيراليون بصفته نائب الرئيسة؛ ومعالي السيدة مارغريتا كاسانغانا من بولندا بصفتها نائبة الرئيسة.
