Assembly of States Parties to the Rome Statute elects a new President and six judges
The Assembly of States Parties to the Rome Statute of the International Criminal Court ("the Assembly") opened its sixteenth session at the United Nations Headquarters in New York, which will last from 4 to 14 December 2017.
In his opening remarks, the President of the Assembly, H. E. Mr. Sidiki Kaba (Senegal), called on all States to work towards the universal ratification of the Rome Statute and the integration of its norms into national legal systems. He underscored the link between State cooperation and the Court's effectiveness, credibility and independence. President Kaba concluded by saying that if a recession of mass crimes results in progressive inactivity at the Court, "We would then have announced the dawn of a new hope for humanity."
The United Nations Secretary-General, H. E. Mr. António Guterres, delivered a keynote speech in which he observed that "the adoption of the Rome Statute was a hopeful, historic moment near the end of a century marked by atrocities and unspeakable inhumanity. Yet serious violations of international law continue, and vast accountability gaps persist. Our abiding challenge is to realize the full potential of the International Criminal Court to end impunity and build a just and more peaceful world."
The Chair of the Board of Directors of the Trust Fund for Victims, Mr. Motoo Noguchi, noted the significance of the first reparations to victims ordered by the Court and implemented by the Trust Fund for Victims.

The Assembly elected Judge O-Gon Kwon (Republic of Korea) as President for a three year mandate that starts on 15 December 2017. The Assembly elected further, for the same period, the following other members of the Bureau: Argentina, Australia, Austria, Colombia, Côte d'Ivoire, Denmark, Ecuador, Estonia, France, Gambia, Ghana, Japan, Mexico, the Netherlands, Senegal, Serbia, Slovakia, Slovenia, the State of Palestine, and Uganda. The Assembly deferred the election of the two Vice-Presidents.
The Assembly elected further six judges for a term of nine years:

List A judges have established competence in criminal law, while List B judges have competence in relevant areas of international law, such as international humanitarian law as well as human rights law.
The Assembly also elected six members of the Committee on Budget and Finance for a three-year mandate.
The Assembly will also, inter alia, consider proposals to amend the Rome Statute, discuss the activation of the Court's jurisdiction over the crime of aggression, as well as consider the 2018 budget of the Court.

La Asamblea de los Estados Partes en el Estatuto de Roma de la Corte Penal Internacional (la "Asamblea") inauguró su decimosexto período de sesiones en la Sede de las Naciones Unidas en Nueva York. El período de sesiones se celebra entre el 4 y el 14 de diciembre de 2017.
En su discurso inaugural, el Presidente de la Asamblea, Excmo. Sr. Sidiki Kaba (Senegal), hizo un llamamiento a todos los Estados a efectos de que trabajaran en favor de la ratificación universal del Estatuto de Roma y de la integración de sus normas en los sistemas jurídicos nacionales. Durante su declaración, puso de relieve el vínculo entre la cooperación de los Estados y la efectividad, la credibilidad y la independencia de la Corte. El Presidente Kaba concluyó señalando que si los crímenes masivos se redujeran y, con ello, disminuye progresivamente la actividad de la Corte, "habremos anunciado el inicio de una nueva era de esperanza para la humanidad".
El Secretario General de las Naciones Unidas, Excmo. Sr. António Guterres, pronunció un discurso de apertura durante el cual señaló que "la aprobación del Estatuto de Roma constituyó un momento histórico y esperanzador en los días finales de un siglo marcado por las atrocidades y por una inhumanidad inenarrable. Sin embargo, las graves vulneraciones del derecho internacional aún persisten, y también perduran enormes lagunas en cuanto a la rendición de cuentas. Nuestro desafío permanente consiste en lograr el desarrollo de la plena capacidad de la Corte Penal Internacional para poner fin a la impunidad y crear un mundo justo y más pacífico."
El Presidente del Consejo de Dirección del Fondo Fiduciario para las Víctimas, Sr. Motoo Noguchi, resaltó la importancia de que por primera vez la Corte haya ordenado, y que el Fondo Fiduciario haya implementado, reparaciones para las víctimas.

La Asamblea eligió como Presidente al Magistrado O-Gon Kwon (República de Corea) por un mandato de tres años que iniciará el 15 de diciembre de 2017. La Asamblea también eligió, para el mismo período, a los siguientes miembros adicionales de la Mesa: Argentina, Australia, Austria, Colombia, Côte d'Ivoire, Dinamarca, Ecuador, Estado de Palestina, Estonia, Eslovaquia, Eslovenia, Francia, Gambia, Ghana, Japón, México, Países Bajos, Senegal, Serbia y Uganda. La Asamblea también eligió seis miembros del Comité de Presupuesto y Finanzas por un mandato de tres años.
Asimismo, la Asamblea estudiará propuestas de enmiendas al Estatuto de Roma, debatirá la activación de la competencia de la Corte sobre el crimen de agresión y examinará el presupuesto de la Corte para 2018, entre otras cosas.

افتتحت جمعية الدول الأطراف في نظام روما الأساسي للمحكمة الجنائية الدولية ("الجمعية") دورتها السادسة عشرة، المعقودة في الفترة من 4 إلى 14 كانون الأول/ ديسمبر 2017، في مقر الأمم المتحدة بنيويورك.
ودعا رئيس الجمعية، السيد صديقي كابا (السنغال)، في كلمته الافتتاحية، جميع الدول إلى العمل من أجل التصديق العالمي على نظام روما الأساسي وإدراج قواعده في النظم القانونية الوطنية. وشدد على الصلة بين تعاون الدول وفعالية المحكمة ومصداقيتها واستقلالها. واختتم الرئيس كابا كلمته بالقول بأنه إذا أدى تراجع الجرائم الجماعية إلى توقف نشاط المحكمة بالتدريج، "سنكون قد أعلنا عندئذ فجر أمل جديد للبشرية".
وألقى الأمين العام للأمم المتحدة، صاحب السعادة السيد أنطونيو غوتيريس، كلمة رئيسية أشار فيها إلى أن "اعتماد نظام روما الأساسي كان لحظة تاريخية مفعمة بالأمل قرب نهاية قرن تميز بفظائع ووحشية يعجز اللسان عن وصفهما. بيد أن الانتهاكات الخطيرة للقانون الدولي مستمرة وما زالت هناك ثغرات كبيرة في المساءلة. والتحدي المستمر الذي يواجهنا هو تحقيق الإمكانات الكاملة للمحكمة الجنائية الدولية لوضع حد للإفلات من العقاب وبناء عالم عادل وأكثر سلاما".
وأشار رئيس مجلس إدارة الصندوق الاستئماني للضحايا، السيد موتو نوغوشي، إلى أهمية أول عملية لجبر أضرار الضحايا التي أمرت بها المحكمة والتي قام الصندوق الاستئماني للضحايا بتنفيذها.
وألقت كل من رئيسة المحكمة الجنائية الدولية والمدعية العامة بيانًا افتتاحيًا، ويمكن الإطلاع عليهما في البيان الصحفي الصادر عن المحكمة والمتوفر على موقعها الشبكي.
وانتخبت الجمعية القاضي أو- غون كوون (جمهورية كوريا) رئيسا للجمعية لولاية مدتها ثلاث سنوات اعتبارا من 15 كانون الأول/ ديسمبر 2017. وانتخبت الجمعية أيضا، ولنفس المدة، أعضاء المكتب الآخرين: استراليا، واستونيا، وأوغندا، والدانمرك، ودولة فلسطين، وسلوفاكيا، وسلوفينيا، والسنغال، وصربيا، وغامبيا، وغانا، وفرنسا، وكوت ديفوار، والنمسا، وهولندا، واليابان. وأرجأت الجمعية انتخاب نائبي الرئيس وأعضاء المكتب من مجموعة بلدان أمريكا اللاتينية ومنطقة البحر الكاريبي.
