As Darfur rebel commanders surrender to the Court, ICC Prosecutor “welcomes compliance with the Court’s decisions and with Resolution 1593 (2005) of the Security Council.”
As Darfur rebel commanders Abdallah Banda and Saleh Mohammed Jerbo Jamus arrive in The Hague for their 17 June voluntary appearance at the International Criminal Court (ICC), to answer charges of war crimes for their roles in the 2007 attack against African Union peacekeepers in Haskanita, ICC Prosecutor Moreno-Ocampo stressed the significance of such co-operation. “It shows the importance of co-operation by all parties to the conflict, as required by United Nations Security Council Resolution 1593.”
“This is the culmination of months of efforts to secure the co-operation of Mr Banda and Mr Jerbo” said the Prosecutor. “The Security Council, when it referred the Darfur situation to the Court, requested Sudan and all parties to the conflict to fully co-operate with my office. As I reported to the Security Council last week, the rebel groups have shown respect for the Court’s decisions", he said.
“The appearance of the two suspects means that all the persons we wish to prosecute in connection with the Haskanita attack have now appeared before the Court.”
“My office had also offered the option of a voluntary surrender to Ahmad Harun and Ali Kushayb”, said the Prosecutor. “However, they refused to co-operate and the judges issued arrest warrants against them. The Government of the Sudan has refused to execute the warrants and has been found in non compliance of UNSC orders.”
“The rebel commanders will now face justice. Their attack on the Haskanita African Union camp in 2007 caused the death of 12 African Union peacekeepers - and worsened the plight of the thousands of civilians they came to help by leaving them without protection.”
Banda and Jerbo are the second and third persons respectively, to appear before the Court voluntarily in response to a summons. They were initially charged together with rebel commander Bahar Idriss Abu Garda, who voluntarily appeared before the Court on 18 May, 2009. Following his confirmation hearing on 19 October, 2009, ICC judges found that the attack constituted a crime under the Statute but that the evidence was insufficient to establish his individual criminal responsibility. The Prosecutor will therefore present additional evidence in a new confirmation hearing.
The International Criminal Court is an independent, permanent court that investigates and prosecutes persons accused of the most serious crimes of international concern, namely genocide, crimes against humanity and war crimes if national authorities with jurisdiction are unwilling or unable to do so genuinely.
The Office of the Prosecutor is currently investigating in five situations: The Democratic Republic of Congo, Northern Uganda, the Darfur region of Sudan, the Central African Republic and Kenya.

مع استسلام إثنين من قادة التمرد في دارفور إلى المحكمة، المدعي العام للمحكمة الجنائية الدولية "يرحب بالامتثال لقرارات المحكمة ولقرار مجلس الأمن رقم 1593 (2005)"

مع وصول إثنين من قادة التمرد في دارفور، عبد الله بندا وصالح محمد جربو جاموس، إلى لاهاي لمثولهما طوعاً أمام المحكمة الجنائية الدولية في 17 حزيران/يونيو 2010 للرد على اتهامات بارتكاب جرائم حرب لدورهما في الهجوم الذي شُنَّ ضد قوات حفظ السلام التابعة للاتحاد الأفريقي في حسكنيتا في عام 2007، أكد المدعي العام للمحكمة الجنائية الدولية مورينو أوكامبو على أهمية مثل هذا التعاون. إذ قال المدعي العام: "هذا يُظهر أهمية التعاون من جانب جميع أطراف الصراع، على النحو المطلوب حسب قرار مجلس الأمن التابع للأمم المتحدة رقم 1593".
وقال المدعي العام: "يعتبر هذا تتويجاً للجهود التي بُذلت لشهور من أجل ضمان تعاون السيد/ بندا والسيد/ جربو". ومضى قائلاً: "عندما أحال مجلس الأمن الوضع في دارفور إلى المحكمة، طلب من السودان ومن جميع أطراف الصراع التعاون الكامل مع مكتبي. وكما أبلغتُ مجلس الأمن في الأسبوع الماضي، أظهرت الجماعات المتمردة احتراماً لقرارات المحكمة".
"إن مثول المشتبهين فيهما يعني أن جميع الأشخاص الذين نود مقاضاتهم بخصوص الهجوم الذي وقع على حسكنيتا قد مثلوا الآن جميعاً أمام المحكمة".
وأضاف المدعي العام قائلاً: "كان مكتبي قد عرض أيضاً خيار الاستسلام الطوعي لأحمد هارون وعلي كوشيب". وقال المدعي العام: "إلا أنهما رفضا التعاون فأصدر القضاة مذكرات اعتقال بحقهما. وقد رفضت الحكومة السودانية تنفيذ مذكرات الاعتقال وأصبحت بذلك غير ممتثلة لأوامر مجلس الأمن التابع للأمم المتحدة".
"سيواجه قادة التمرد الآن العدالة. لقد تسبب هجومهم على معسكر الاتحاد الأفريقي في حسكنيتا في عام 2007 في وفاة 12 عنصراً من عناصر قوات حفظ السلام التابعة للاتحاد الأفريقي. كما فاقم من محنة الآلاف من المدنيين، الذين جاءت القوات لحمايتهم، لأنهم أصبحوا من دون حماية".
إن بندا وجربو هما الشخصان الثاني والثالث على التوالي اللذان مثولا طواعية أمام المحكمة استجابة لأمر بالحضور. لقد وجهت لهما في البداية تُهماً إلى جانب قائد المتمردين بحر إدريس أبو قردة الذي مثول طواعية أمام المحكمة في 18 أيار/مايو 2009. وعقب جلسة الاستماع التي عُقدت في 19 تشرين الأول/أكتوبر 2009 لاعتماد التُّهم، رأى قضاة المحكمة الجنائية الدولية أن الهجوم يُشكل جريمة بموجب النظام الأساسي إلا أن الأدلة لم تكن كافية لإثبات مسؤوليته الجنائية الفردية. وعليه، سيُقدم المدعي العام أدلة إضافية لجلسة استماع جديدة لاعتماد التُّهم.
إن المحكمة الجنائية الدولية محكمة مستقلة ودائمة تحقق مع الأشخاص المتهمين في الجرائم الشديدة الخطورة ذات الإهتمام الدولي - ألا وهي جريمة الإبادة الجماعية، الجرائم ضد الإنسانية، جرائم الحرب - وذلك إذا لم ترغب أو لم تستطع السلطات الوطنية ذات الولاية القضائية القيام بذلك بشكل صحيح.
يجري مكتب المدعي العام حالياً تحقيقاً في خمسة أوضاع: جمهورية الكنغو الديمقراطية، شمال يوغندا، إقليم دارفور في السودان، جمهورية أفريقيا الوسطى، كينيا.
