The Office of the Prosecutor concludes mission to Colombia

In the context of its on-going preliminary examination of the situation in Colombia, a delegation from the Office of the Prosecutor ("Office") of the International Criminal Court ("ICC" or the "Court") conducted a mission to the Republic of Colombia from 19 to 23 January 2020. The purpose of the mission was for the Office to engage in constructive discussions with the Government authorities to assess progress of national proceedings in relation to the areas of focus identified in the interim report on the situation, published in November 2012. In addition, the Office held valuable talks with representatives from international organisations and members of civil society, whose views and concerns continue to inform the Office's assessment of the situation. 

The delegation's engagement with the authorities and other stakeholders focused in particular on national proceedings addressing the promotion and expansion of paramilitary groups; forced displacement; sexual and gender-based crimes; and, the killings known as "false positives". In addition, the Office held consultations relating to legislative and other developments that could have an impact on national proceedings relating to Rome Statute crimes. 

The delegation further held consultations relating to the development of indicators and benchmarks in order to assess the current national efforts to provide accountability for Rome Statute crimes, including the Special Jurisdiction for Peace ("SJP"), as well as proceedings carried out under the ordinary justice and the Justice and Peace Law systems.

While the Office is yet to define the content of such benchmarks and conditions, initial consultations with the Colombian authorities and other stakeholders were carried out in the context of the visit. The Office stresses that its assessment of the national efforts is still ongoing and will continue alongside the development of the indicators mentioned above.

The Office looks forward to the continued engagement with the Government of Colombia, international organisations and civil society on this and other aspects of the preliminary examination.

The Office restates its support to Colombia's peace process and the implementation of exhaustive measures to achieve justice, in line with its obligations under the Rome Statute.  In this sense, the Office reiterates the importance of the SJP and the necessity to maintain its integrity and independence, as well as the need to provide it with the necessary resources and support to carry out its important mandate.

The Office stands ready to support the SJP's efforts to develop adequate mechanisms, techniques and procedures, with a view to reaching decisions, which are both legally and factually compatible with the admissibility requirements of the Rome Statute.

The Office further notes the importance of developing rigorous and effective measures and systems for the proper implementation, verification and monitoring of the sanctions imposed by the SJP, in particular those imposing restrictions on liberty. 

Finally, the Office stresses the importance of national agencies fully cooperating with the SJP, including by timely providing the information necessary for the SJP to fulfil its mandate, in particular the transmission of information gathered in all relevant judicial proceedings.  Such cooperation should also include facilitating the voluntary appearance of persons before the SJP, and taking all necessary steps to ensure the safety and well-being of those persons. 

The Prosecutor expresses her gratitude to the Government of Colombia for providing its support to the Office delegation's visit and facilitating the meetings with national authorities.

The Office of the Prosecutor of the ICC conducts independent and impartial preliminary examinations, investigations and prosecutions of the crime of genocide, crimes against humanity, war crimes and the crime of aggression. Since 2003, the Office has been conducting investigations in multiple situations within the ICC's jurisdiction, namely in Uganda; the Democratic Republic of the Congo; Darfur, Sudan; the Central African Republic (two distinct situations); Kenya; Libya; Côte d'Ivoire; Mali; Georgia and Burundi. The Office is also currently conducting preliminary examinations relating to the situations in Colombia; Guinea; Iraq/UK; the Philippines; Nigeria; Ukraine; and Venezuela.

En el marco de su examen preliminar en curso sobre la situación en Colombia, una delegación de la Fiscalía de la Corte Penal Internacional (la "CPI" o la "Corte") realizó una misión a la República de Colombia entre el 19 y el 23 de enero de 2020. El propósito de esta misión era que la Fiscalía mantuviese discusiones constructivas con las autoridades del Gobierno a los efectos de evaluar el avance de los procedimientos nacionales en relación con las áreas de interés identificadas en el Reporte Intermedio sobre la situación, publicado en noviembre de 2012. Además, la Fiscalía tuvo conversaciones valiosas con representantes de organizaciones internacionales y miembros de la sociedad civil, cuyos puntos de vista y preocupaciones siguen informando el análisis de la Fiscalía sobre la situación.

Las interacciones de la delegación con las autoridades y otros actores interesados se centraron en particular sobre los procedimientos nacionales que abordan la promoción y expansión de los grupos paramilitares; desplazamiento forzoso; delitos sexuales y de género; y los homicidios conocidos como "falsos positivos". Además, la Fiscalía llevó a cabo consultas relativas a los desarrollos legislativos y de otro tipo que podrían tener un impacto sobre los procedimientos nacionales relativos a los crímenes del Estatuto de Roma.

La delegación de la Fiscalía también celebró consultas relativas al desarrollo de indicadores y puntos de referencia a fin de evaluar los esfuerzos nacionales actuales para lograr la rendición de cuentas respecto de crímenes del Estatuto de Roma, incluyendo aquellos llevados a cabo por la Jurisdicción Especial para la Paz ("JEP") así como también los procedimientos llevados a cabo ante los tribunales ordinarios y del sistema de la Ley de Justicia y Paz.

Si bien la Fiscalía todavía debe definir el contenido de tales puntos de referencia y condiciones, se realizaron consultas iniciales con las autoridades colombianas y otros actores interesados en el marco de la visita. La Fiscalía pone de relieve que su evaluación de los esfuerzos nacionales todavía está en curso y continuará paralelamente al desarrollo de los indicadores mencionados.

La Fiscalía espera con interés mantener la interacción con el Gobierno de Colombia, las organizaciones internacionales y con la sociedad civil sobre este y otros aspectos del examen preliminar.

La Fiscalía reitera su apoyo al proceso de paz en Colombia y a la implementación de medidas exhaustivas para lograr justicia, en línea con sus obligaciones con arreglo al Estatuto de Roma.

En este sentido, la Fiscalía reitera la importancia de la JEP y la necesidad de mantener su integridad e independencia, así como la importancia de proporcionarle los recursos y el apoyo necesarios para llevar adelante su importante mandato.

La Fiscalía está preparada para apoyar los esfuerzos de la JEP para desarrollar mecanismos, técnicas y procedimientos adecuados, con el objetivo de alcanzar decisiones que sean tanto jurídica como fácticamente compatibles con los requisitos de admisibilidad del Estatuto de Roma.

La Fiscalía también pone de relieve la importancia de desarrollar medidas rigurosas y efectivas y sistemas para la implementación, verificación y monitoreo adecuados de las sanciones impuestas por la JEP, en particular aquellas que impongan restricciones a la libertad.

En último lugar, la Fiscalía subraya la importancia de que los órganos nacionales cooperen plenamente con la JEP, incluyendo a través de proporcionar de manera expedita la información necesaria para que la JEP cumpla su mandato, en particular la transmisión de información recolectada en todos los procedimientos judiciales pertinentes. Tal cooperación deberá también incluir el facilitar la aparición voluntaria de personas ante la JEP, y dar todos los pasos necesarios para asegurar su seguridad y su bienestar.

La Fiscal desea expresar su gratitud al Gobierno de Colombia por brindar su apoyo a la visita de la delegación de la Fiscalía y facilitar las reuniones con las autoridades nacionales.

La Fiscalía de la CPI realiza exámenes preliminares, investigaciones y enjuiciamientos independientes e imparciales de los crímenes de genocidio y lesa humanidad, crímenes de guerra y el crimen de agresión. Desde 2003, la Fiscalía ha llevado a cabo investigaciones en varias situaciones que son de la competencia de la CPI, a saber, en Burundi, Côte d´Ivoire, Darfur (Sudán), Georgia, Kenya, Libia, Malí, Uganda, la República Centroafricana (dos investigaciones distintas), y la República Democrática del Congo. La Fiscalía también está llevando a cabo exámenes preliminares sobre las situaciones en Colombia, Guinea, Iraq/Reino Unido, Nigeria, Filipinas, Ucrania y Venezuela.
