Al Hassan Ag Abdoul Aziz Ag Mohamed Ag Mahmoud makes first appearance before the ICC

On 4 April 2018, Al Hassan Ag Abdoul Aziz Ag Mohamed Ag Mahmoud ("Al Hassan") appeared before the single judge of Pre-Trial Chamber I of the International Criminal Court ("ICC" or "Court"), judge Marc Perrin de Brichambaut, at the seat of the ICC in The Hague (The Netherlands). The Single Judge provisionally set the date of the beginning of the confirmation of charges hearing in respect of Mr Al Hassan for 24 September 2018.

The hearing was held in the presence of the Prosecutor and the Defence. Mr Al Hassan was represented by his Duty Counsel, Yasser Hassan. The Single Judge verified the identity of the suspect, and ensured that he was clearly informed of the crimes he is alleged to have committed and of his rights under the Rome Statute of the ICC in a language he fully understands and speaks, in this case, Arabic.

The opening of the confirmation of charges hearing is provisionally scheduled for 24 September 2018. The purpose of the confirmation of charges hearing is to determine whether there is sufficient evidence to establish substantial grounds to believe that the person committed each of the crimes charged. If the charges are confirmed, the case will be transferred to a Trial Chamber, which will conduct the subsequent phase of the proceedings: the trial.

Background:  Mr Al Hassan was transferred to the ICC on 31 March 2018 following an arrest warrant issued by the Chamber on 27 March 2018 for war crimes and crimes against humanity.

According to the arrest warrant, Mr Al Hassan, a Malian national born on 19 September 1977 in the community of Hangabera, about 10 kilometres north of Goundam in the region of Timbuktu, Mali, and belonging to the Tuareg/Tamasheq tribe Kel Ansar, was a member of Ansar Eddine and de facto chief of Islamic police. He is also alleged to have been involved in the work of the Islamic court in Timbuktu and to have participated in executing its decisions. Mr Al Hassan is further alleged to have taken part in the destruction of the mausoleums of Muslim saints in Timbuktu using Islamic police forces in the field, and to have participated in the policy of forced marriages which victimized the female inhabitants of Timbuktu and led to repeated rapes and the sexual enslavement of women and girls.

The Chamber is satisfied that the evidence submitted by the Prosecution provides reasonable grounds to believe that Mr Al Hassan is criminally responsible under article 25(3)(a) or 25(3)(b) of the Rome Statute for crimes against humanity (torture, rape and sexual slavery; persecution of the inhabitants of Timbuktu on religious and gender grounds; and other inhumane acts) and for war crimes (rape and sexual slavery; violence to person and outrages upon personal dignity; attacks intentionally directed against buildings dedicated to religion and historic monuments; and the passing of sentences without previous judgement pronounced by a regularly constituted court affording all judicial guarantees which are generally recognized as indispensable) committed in Timbuktu, Mali, between April 2012 and January 2013.

مثل الحسن أغ عبد العزيز أغ محمد أغ محمود ("الحسن")، اليوم 4 نيسان/أبريل 2018، أمام القاضي مارك بيران دو بريشمبو وهو القاضي المنفرد الذي يضطلع بمهام الدائرة التمهيدية الأولى في المحكمة الجنائية الدولية ("المحكمة") في مقرّ المحكمة في لاهاي بهولندا. وحدّد القاضي المنفرد 24 أيلول/سبتمبر 2018 موعداً مؤقتاً لبدء جلسة اعتماد التهم الموجَّهة إلى السيد الحسن.

وعُقِدت جلسة المثول الأول بحضور الادعاء والدفاع. ومثَّل السيد الحسن محاميه المناوب، الأستاذ ياسر حسن. وتحقّق القاضي خلال الجلسة من هوية المشتبه به وتأكّد من أنه أحيط علماً بوضوح بالجرائم المنسوبة إليه وبالحقوق التي يتمتع بها بموجب نظام روما الأساسي بلغة يفهمها تماما ويتكلمها بطلاقة أي اللغة العربية.

وقد حُدِّد 24 أيلول/سبتمبر 2018 موعداً مؤقتاً لعقد جلسة اعتماد التهم. وترمي هذه الجلسة إلى البت فيما إذا كانت توجد أدلة كافية لإثبات وجود أسباب جوهرية تدعو للاعتقاد بأن المشتبه به قد ارتكب كل جريمة من الجرائم المنسوبة إليه. وفي حال اعتماد التهم، تُحال القضية إلى دائرة ابتدائية تتولى عقد المرحلة التالية من الإجراءات القضائية ألا وهي المحاكمة.

معلومات أساسية: نُقِل السيد الحسن إلى عهدة المحكمة في 31 آذار/مارس 2018 بموجب أمر بالقبض عليه أصدرته الدائرة في 27 آذار/مارس 2018 بتهم ارتكاب جرائم حرب وجرائم ضد الإنسانية.

ووفقاً لما يرد في أمر القبض، فقد كان السيد الحسن، المالي الجنسية والمولود في 19 أيلول/سبتمبر 1977 في محلية هنغبيرا، الواقعة على مسافة 10 كيلومترات إلى الشمال من قوندام، في منطقة تمبكتو بمالي والمنتمي إلى قبيلة كل أنصار الطارقية/التماشقية، عضواً في جماعة أنصار الدين ورئيساً بحكم الأمر الواقع للشرطة الإسلامية. كما يُدَّعى بأنه ساهم في أعمال المحكمة الإسلامية في تمبكتو وشارك في تنفيذ قراراتها. ويُدعى بأنه اشترك في تدمير أضرحة الأولياء في تمبكتو بالاستعانة بأفراد الشرطة الإسلامية العاملين في الميدان وأنه شارك في تنفيذ سياسة التزويج القسري لنساء تمبكتو مما أسفر عن  ارتكاب جرائم اغتصاب متكررة واستعباد النساء والفتيات جنسيا.

واقتنعت الدائرة بأن الأدلة التي قدّمتها المدعية العامة توفّر أسباباً معقولة للاعتقاد بأن السيد الحسن مسؤول جنائياً بالمعنى المقصود في المادة 25 (3) (أ) أو 25 (3) (ب) من نظام روما الأساسي عن ارتكاب جرائم ضد الإنسانية (التعذيب والاغتصاب والاستعباد الجنسي؛ واضطهاد أهالي تمبكتو المدنيين على أساس الدين ونوع الجنس؛ وأعمال لاإنسانية أخرى) وجرائم حرب (الاغتصاب والاستعباد الجنسي؛ واستعمال العنف ضد الأشخاص والاعتداء على كرامة الشخص؛ وجريمة تعمد توجيه هجمات ضد مبان مخصصة للأغراض الدينية وآثار تاريخية؛ وإصدار عقوبات دون وجود حكم سابق صادر عن محكمة مشكلة تشكيلاً نظامياً تكفل جميع الضمانات القضائية المعترف عموما بأنه لا غنى عنها)، وذلك في تمبكتو بمالي في الفترة الممتدة من نيسان/أبريل 2012 إلى كانون الثاني/يناير 2013.
