Georgia deposited its instrument of ratification to the Rome Statute on 5 September 2003. The ICC therefore has jurisdiction over Rome Statute crimes committed on the territory of Georgia or by its nationals from 1 December 2003 onwards.

Up to and including 01 June 2013, the OTP has received 3,855 communications in relation to the situation in Georgia. The preliminary examination of the situation in Georgia was announced on 14 August 2008.

The Office is seeking clarification as to whether the respective national investigations have halted; whether any additional information remains to be provided to the Office; and whether the lack of cooperation identified as an obstacle both by the Russian and Georgian authorities may be overcome through enhanced mutual legal assistance between the two States.
