State of Palestine becomes the thirtieth State to ratify the Kampala amendments on the crime of aggression
On 26 June 2016 the State of Palestine deposited its instrument of ratification of the amendments to the Rome Statute on the crime of aggression. The State of Palestine thus became the thirtieth State to have ratified the amendments on the crime of aggression.
The President of the Assembly of States Parties to the Rome Statute of the International Criminal Court, H.E. Mr. Sidiki Kaba, welcomed Palestine's ratification of the crime of aggression amendments as a vital contribution towards strengthening the rule of law and holding responsible those leaders who have committed 'the supreme international crime'.
The Review Conference of the Rome Statute, held in 2010 in Kampala (Uganda), adopted, inter alia, a set of amendments relating to the definition of the crime of aggression and the provisions for the exercise of the Court's jurisdiction.
The Court may exercise jurisdiction over the crime of aggression after 1 January 2017, once thirty States Parties have ratified the amendments, and subject to a decision by the Assembly to activate that jurisdiction.
The State of Palestine acceded to the Rome Statute and the Agreement on Privileges and Immunities of the Court ("APIC") on 2 January 2015.
في 26 حزيران/يونيه 2016، أودعت دولة فلسطين صك تصديقها على تعديلات نظام روما الأساسي المتعلقة بجريمة العدوان. وبذلك أصبحت دولة فلسطين الدولة الثلاثين التي تصدّق على التعديلات المتعلقة بجريمة العدوان.
وقد رحّب رئيس جمعية الدول الأطراف، معالي السيد صدّيقي كابا، بتصديق فلسطين على التعديلات المتعلقة بجريمة العدوان باعتباره يشكل إسهاماً حيوياً في تعزيز سيادة القانون وفي تحميل المسؤولية للقادة الذين ارتكبوا 'الجريمة الدولية الأعظم'.
وكان المؤتمر الاستعراضي لنظام روما الأساسي، الذي عُقد في كمبالا (أوغندا) في عام 2010، قد اعتمد، في جملة أمور، مجموعة من التعديلات المتعلقة بتعريف جريمة العدوان والأحكام المتعلقة بممارسة اختصاص المحكمة.
فيجوز للمحكمة أن تمارس الاختصاص بشأن جريمة العدوان بعد 1 كانون الثاني/يناير 2017 متى صدّقت ثلاثون دولة من الدول الأطراف على التعديلات، رهناً بقرار تتخذه جمعية الدول الأطراف بتنشيط هذا الاختصاص.
وقد انضمت دولة فلسطين في 2 كانون الثاني/يناير 2015 إلى نظام روما الأساسي وإلى الاﺗﻔﺎق المتعلق باﻣﺘﻴﺎزات اﻟﻤﺤﻜﻤﺔ اﻟﺠﻨﺎﺋﻴﺔ اﻟﺪوﻟﻴﺔ وحصاناتها.
El 26 de junio de 2016, el Estado de Palestina depositó su instrumento de ratificación de las enmiendas al Estatuto de Roma sobre el crimen de agresión y se convierte así en el trigésimo Estado en ratificar las enmiendas sobre el crimen de agresión.
El Excmo. Sidiki Kaba, Presidente de la Asamblea de los Estados Partes en el Estatuto de Roma de la Corte Penal Internacional, acogió con agrado la ratificación por Palestina de las enmiendas sobre el crimen de agresión señalandola como una contribución fundamental para el fortalecimiento del estado de derecho y la rendición de cuentas de los líderes que han cometido el "crimen internacional supremo".
En la Conferencia de Revisión del Estatuto de Roma, celebrada en 2010 en Kampala (Uganda), se aprobó, entre otros, un conjunto de enmiendas relativas a la definición del crimen de agresión y las disposiciones para el ejercicio de la competencia de la Corte.
La Corte podrá ejercer su competencia respecto del crimen de agresión a partir del primero de enero de 2017, después de la ratificación de las enmiendas por treinta Estados Partes, y con sujección a una decision de la Asamblea que active esa competencia.
El Estado de Palestina se adherió al Estatuto de Roma y al Acuerdo sobre Privilegios e Inmunidades de la Corte el 2 de enero de 2015.
