ASP President, O-Gon Kwon, reaffirms unwavering support for the ICC
In relation to recent statements regarding the International Criminal Court (ICC), I would like to reiterate that the Court and its staff have the strong support of the Assembly of States Parties to the Rome Statute. I reaffirm our full confidence in the Court as an independent and impartial judicial institution and reiterate our strong commitment to uphold and defend the principles and values enshrined in the Rome Statute and to preserve its integrity undeterred by any threats against the Court. I express our deep concern over threats against Court officials, staff and their families.
The ICC embodies our collective commitment to fight impunity for the most serious crimes of international concern. I reiterate our call on all States to respect the judicial and prosecutorial independence of the Court and work together towards ensuring our common aim of fighting impunity for the perpetrators of the gravest crimes under international law.
The Court is an impartial and independent judicial body, its actions governed strictly by the legal framework of the Rome Statute, its founding treaty. One of the cornerstones of the Rome Statute system is that it recognizes the primary jurisdiction of States to investigate and prosecute atrocity crimes. As a court of last resort, the ICC is complementary to national jurisdictions.

The Assembly of States Parties is the management oversight and legislative body of the ICC. It is comprised of representatives of States that have ratified or acceded to the Rome Statute. President Kwon was elected President of the Assembly for a three year mandate in December 2017.
En relación con las declaraciones recientes sobre la Corte Penal Internacional (CPI), quisiera reiterar que la Corte y su personal cuentan con el firme apoyo de la Asamblea de los Estados Partes en el Estatuto de Roma. Reafirmo nuestra plena confianza en la Corte como institución judicial independiente e imparcial y reitero nuestro firme compromiso para apoyar y defender los principios y valores consagrados en el Estatuto de Roma y preservar su integridad sin temor a ningún tipo de amenaza contra la Corte. Expreso nuestra profunda preocupación por las amenazas contra los funcionarios de la Corte, el personal y sus familias.
La CPI encarna nuestro compromiso colectivo de la lucha contra la impunidad por los crímenes más graves de interés internacional. Reitero nuestro llamamiento a todos los Estados para que respeten la independencia judicial y procesal de la Corte y trabajen juntos para garantizar nuestro objetivo común de la lucha contra la impunidad de los autores de los delitos más graves en virtud del derecho internacional.
La Corte es un órgano judicial imparcial e independiente, sus acciones se rigen estrictamente por el marco legal del Estatuto de Roma, su tratado fundacional. Una de las piedras angulares del sistema del Estatuto de Roma es que reconoce la jurisdicción primaria de los Estados para investigar y enjuiciar los crímenes atroces. Como corte de último recurso, la CPI es complementaria a las jurisdicciones nacionales.

La Asamblea de los Estados Partes es el órgano legislativo y de supervisión de la Corte Penal Internacional. Está compuesto por representantes de los Estados que han ratificado o se han adherido al Estatuto de Roma. El presidente Kwon fue elegido presidente de la Asamblea por un mandato de tres años en diciembre de 2017.
تبعاً للتصريحات المستجدة حول المحكمة الجنائية الدولية، أود أن أجدد الإعراب عن الدعم القوي الذي تحظى به المحكمة وموظفوها من جمعية الدول الأطراف في نظام روما الأساسي. وأؤكد مجدَّداً ثقتنا الكاملة في المحكمة كهيئة قضائية مستقلة ومحايدة، وأجدد التزامنا الراسخ بصون المبادئ والقيم التي كرَّسها نظام روما الأساسي وبالدفاع عنها، والعمل على بقاء النظام الأساسي محفوظاً، لا تردعنا في ذلك أي تهديدات تُساق ضد المحكمة. كما أعرب عن عميق قلقنا إزاء التهديدات الموجهة ضد مسؤولي المحكمة وموظفيها وذويهم.
تُجسِّد المحكمة الجنائية الدولية التزامنا الجماعي بمكافحة الإفلات من العقاب عن أخطر الجرائم التي تثير قلق المجتمع الدولي. وأجدد هنا دعوة كل الدول إلى احترام استقلال الجهاز القضائي للمحكمة واستقلال ادعائها العام وإلى العمل معاً لتحقيق الغاية التي تجمعنا، ألا وهي مكافحة الإفلات من العقاب بالنسبة لمرتكبي أكثر الجرائم جسامة التي تقع تحت طائلة القانون الدولي.
إنَّ هذه المحكمة هيئة قضائية مستقلة ومحايدة، لا تخرج أعمالها عن الإطار القانوني الذي وضعه نظام روما الأساسي، الذي نشأت بمقتضاه. وأحد أركان هذا النظام هو إقراره بالاختصاص الأولي للدول في التحقيق والمقاضاة في الجرائم الفظيعة. والمحكمة الجنائية الدولية هي محكمة الملاذ الأخير، تقوم بدورها مكملة للولايات القضائية الوطنية.

جمعية الدول الأطراف هي هيئة الإشراف الإداري والهيئة التشريعية للمحكمة الجنائية الدولية. وهي تتألف من ممثلي الدول التي صدقت على نظام روما الأساسي أو انضمت إليه. تم انتخاب الرئيس كوون رئيسًا للجمعية في ديسمبر 2017 لفترة ولاية مدتها ثلاث سنوات.
